Resolution Number 63-11-26-5�o RESOLUTION NO. 63_11_26-5 On a motion of Councilman Durnford, the following resolution was offered for adoption: Whereas, the San Juan Elementary School District conveyed an easement for sewer facilities to a width of 20 feet to the San Juan Capistrano Sanitary District; and Whereas, said San Juan Capistrano Sanitary District was dissolved by operation of law, upon the incorporation of the City of San Juan Capistrano, a municipality, on the 19th day of April, 1961; and Whereas, the City of San Juan Capistrano, through the City Council, is the jurisdictional agency for the administration and operation of said dissolved sanitary district facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby give notice of intention to vacate and/or abandon an easement, 20 feet in width, formally to be utilized for sewer facilities and/or appurtenances. Said easement lies and extends easterly from Acjachema Street and across property owned by the afore- mentioned San Juan Elementary School District. BE IT FURTHER RESOLVED that the proceedings of such notice of intention to vacate will be held in the City Hall, 31762 Camino Capistrano, at 8:00 P. M., Monday, December 23, 1963. Notice is further given that at said time and place, all interested persons are invited to attend said proceedings and be heard in favor of or opposition to said intention to vacate or abandon the aforementioned easement, either orally or by written communication to the City Clerk. Further, these proceedings are in accordance with Section 8331, Streets and Highways Code, State of California. Passed, approved and adopted by a unanimous vote.
