Resolution Number 63-2-25-1215 RESOLUTION NO. 63-2_25-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, EXPRESSING OPPOSITION TO ASSEMBLY BILL NO. 28 WHEREAS, the San Bernardino Valley Municipal Water District has not .determined to join the Metropolitan Water District to relieve their acute water shortage, but is attempting to require other cities and agencies to relieve their water shortage by State legislation proposed as Assembly Bill No. 28; and WHEREAS, Assembly Bill No. 28 is special legislation for the sole benefit of the San Bernardino Valley Municipal Water District and is an attempt to have the State Legislature compel other cities and districts to render relief to said San Bernardino Valley Municipal Water District in a manner which would reward refusal to accept the burden providing water by voluntary contract to relieve the voters of the San Bernardino Valley Municipal Water District of their vote against membership in the Metropolitan Water District; and WHEREAS, the Metropolitan Water District is composed of cities and districts voluntarily associated to provide the plant and facilities at their own expense for the supplying of their own water, a situation of self help in the basic American tradition; and WHEREAS, the City of San Juan Capistrano is within the Orange County Water Works District No. 4 of a participating agency (the Orange County Municipal Water District) which participates in the Metropolitan Water District and therefore this city believes that other areas should be allowed to join the District, but that no area should be supplied special privileges and benefits by State legislation and so relieved of any obligation to join with its sister cities and districts. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of San Juan Capistrano hereby respectfully petitions the Baerd of Supervisors of the County of Orange opposition acting as a Board of Directors of Orange County Waterworks District No. 4 to petition the California Legislature and the individual members thereof to vote in opposition to Assembly Bill No. 28 and express to said individual members its complete and unalterable opposition to said Assembly Bill No. 28 as now pro- posed and unalterable opposition to any modification, amendment or change in said bill. BE IT FURTHER RESOLVED: That a request be extended to the Orange County Municipal Water District by your Honorable Board to adopt a similar resolution opposing said Assembly Bill No. 28 in the belief that the idea back of such approach is basically wrong and an unexcusable invasion of the home rule principle of special privilege legislation that should never be supported or favored by any informed person. 216 PASSED AND ADOPTED by the City Council of the City of San Juan Capistrano at its regular meeting held on the 25th day of February, 1963.
