Resolution Number 66-12-19-3315 RESOLUTION NO. 66-12-19-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE ANNEXATION TO THE CITY OF SAN JUAN CAPISTRANO OF THE TERRITORY KNOWN AND DESIGNATED AS MISSION HILLS RANCH ANNEXATION WHEREAS, the City Council of the City of San Juan Capistrano did on the 28th day of November, 1966, receive a written petition asking that certain new terri- tory described in said petition be annexed to the City of San Juan Capistrano; and WHEREAS, prior to the circulation or filing of said petition, notice of intention to annex said territory, containing the specific boundaries of the terri- tory to be annexed, was filed with the Local Agency Formation Commission, and said Local Agency Formation Commission rendered its decision, as provided in Section 54797 of the Government Code, approving said annexation; and WHEREAS, said territory proposed to be annexed to said City of San Juan Capistrano is situated in the County of Orange, State of California, and is contiguous to the City of San Juan Capistrano, and is uninhabited territory. That said petition contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council duly assembled at a regular meeting of said City Council held on the 28th day of November, 1966, did find that said petition at the time it was filed and received was signed by the owners of not less than one-fourth of the land in the territory by area and by assessed value, as shown on the last preceding equalized assessment roll of the County of Orange, State of California, in which said territory is situated, and that said territory did not form a part of any municipal corporation, and did find that said territory is contiguous to the City of San Juan Capistrano and is uninhabited territory; and WHEREAS, on the 28th day of November, 1966, at a regular meeting of said City Council of the City of San Juan Capistrano, Resolution No. 66-11-28-1 was duly passed and adopted specifically describing the boundaries of the territory so proposed to be annexed to the City of San Juan Capistrano, designating such territory as MISSION HILLS RANCH ANNEXATION, giving notice of such annexation and fixing the 12th day of December, 1966, at the hour of 6:00 o'clock P.M. at the City Council Chamber in the City Hall of the City of San Juan Capistrano as the day, hour and place when and where the City Council would hear protests made by any owner of real property within the City who does not also own property in the territory proposed to be annexed, and directing the City Clerk to publish or cause to be published a copy of said resolution in a newspaper of general circulation, published in the City of San Juan Capistrano, to wit: The Coastline Dispatch, and directing that said publication 316 be completed at least four (4) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of San Juan Capistrano to cause written notice of such proposed annexation to be mailed to any person who had filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of San Juan Capistrano is owned by a County, that the City Clerk should cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, and directing that such notices be given not less than twenty (20) days before the first public _ hearing on the proposed annexation; and WHEREAS, on the hour, day and at the place specified in said Resolution No. 11-11-28-1, to wit: On the 12th day of December, 1966, at the hour of 6:00 o'clock P.M. in the City Council Chamber in the City Hall in the City of San Juan Capistrano, California, there being no quorum present, said meeting was adjourned to the 19th day of December, 1966 at the hour of 6:00 o'clock P.M. in the City Council Chamber in the City Hall in the City of San Juan Capistrano, California, at which time and place the City Council of the City of San Juan Capistrano did meet and assemble to hear and pass on all protests filed or received up to the closing of the hearing on said protests. That the City Council did find that the resolution fixing the time and place of said hearing was published by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed by the City Clerk to each person who had filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with the City Clerk as directed in said resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano that the annexation of the territory included within the boundaries of the MISSION HILLS RANCH ANNEXATION, and more particularly desctibed as follows, to wit: Those portions of Sections 30 and 31, Township 7 South, Range 7 West, and Section 36, Township 7 South, Range 8 West, S.B.M., in the County of Orange, State of California, described as follows: Beginning at an angle point in the boundary of the Rosenbaum Annex- ation to the City of San Juan Capistrano as certified by the Secretary of State, January 28, 1965, said angle point being in the southwesterly line of the Rancho Mission Viejo, per map thereof, filed in Book 9, page 8 of Records of Survey of said Orange County, distant along said boundary and said southwesterly line South 530 44' 07" East 1877.23 feet from the intersection thereof with the east -west centerline of 31'7 Section 25, Township 7 South, Range 8 West, S.B.M., thence leaving said boundary South 530 414' 07" East along said southwesterly line 5078.40 feet to an angle point in the original boundary of said City as certified by the Secretary of State, April 19, 1961, said angle point being at the easterly terminus of that certain course described as South 890 34' 05" East 1417.99 feet in said original boundary; thence along said boundary the following described courses: North 891 34' 05" West 1417.99 feet; North 00 07' 42" West 116.00 feet; North 890 59' 42" West 3915.28 feet and North 89° 54' 42" W st 1319.87 feet to said boundary of the Rosenbaum Annexation; thence along last said boundary the following described courses: North 00 36' 08" East 319.24 feet; North 540 56' 18" East 501.94 feet; North 390 39' 20" East 655.90 feet; North 880 17' 40" East 710.25 feet; North 530 18' 36" East 256.90 feet; North 700 30' 16" East 373.99 feet; South 620 35' 02" East 310.00 feet; North 120 08' 03" East 423.62 feet; North 120 12' 12" West 206.74 feet and North 70 57' 03" East 999.28 feet to the point of beginning, containing an area of 198.14 acres, is hereby approved and said territory is hereby annexed to and incorporated in the City of San Juan Capistrano, County of Orange, State of California, and is hereby designated as the MISSION HILLS RANCH ANNEXATION to the City of San Juan Capistrano. BE IT FURTHER RESOLVED that from and after the date of the adoption of this resolution and the filing of a certified copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of San Juan Capistrano, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of San Juan Capistrano and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of San Juan Capistrano contracted prior to or existing at the time of such annexation pursuant to the written gonsent of the owners of property in said annexed territory filed with the Clerk of the City of San Juan Capistrano prior to the adoption of this resolution. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and cause the same to be published once in the Coastline Dispatch, a newspaper of general circulation, printed, published and circulated in the City of San Juan Capistrano, County of Orange, State of California. 318 THE FOREGOING RESOLUTION is approved an December, 1966.
