Resolution Number 66-4-25-324U RESOLUTION NO. 66-4-25-3 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN CHANGES AND MODIFI- CATIONS IN THE WORK AND PROCEEDINGS FOR THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN ASSESS- MENT DISTRICT NO. 64-1 IN SAID CITY: DESCRIBING SAID PROPOSED CHANGES AND MODIFICATIONS AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED CHANGES AND MODIFICATIONS WHEREAS, this City Council did on the 14th day of December, 1964, adopt its Resolution of Intention No. 64-12_14-1 declaring its intention to order the con- struction of certain improvements and acquisitions in Assessment District No. 64-1 in the City of San Juan Capistrano, California; and WHEREAS, Engineering Science, Inc., has recommended and presented to this Council a certain change order designated Contract Change Order No. 3 recommending certain changes in the work be ordered and made in Assessment District No. 64-1 in the City of San Juan Capistrano. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AS FOLLOWS: SECTION 1. That pursuant to a signed change order designated Contract Change Order No. 3, said change order on file in the office of the City Clerk of this City and by reason of the recommendations of the Engineer of Work, in the public interest and convenience, it is the intention of the City Council of the City of San Juan Capistrano, California, to order the following changes and modifi- cations all as listed on said Contract Change Order No. 3 recommended by the Engineer of Work. 1. Furnish only 104 lineal feet of 8 -inch diameter A.C. Pipe which shall be installed by the local Orange County Water District forces. Increase in contract price, which includes taxes, delivery, and all related costs. $107.34 No change in contract time This change is necessitated because a water line at approximate station 111 + 90, line T-1, sheet 13, which was installed after the plans were prepared and was not shown on the drawings. Portions of this water line were subsequently removed during construction. 2. a. Within the parcel of land westerly of Line L-2.11, downstream of 3 + 93.39, protect the existing horse trough, grout lined storm channel, corral fence, horse shade structure, grouted retaining wall and other improvements all as if they were shown on the contract drawings. b. Care and protect the horses as if the corral and horses existed in their present location at the time of receipt of construction bids. Increase in contract price for item (a) $979.95 Increase in contract price for item (b) $640.00 Increase in contract time 1 day 241 This change is necessitated because all of the above improvements were constructed after the receipt of construction bids and consequently were not shown on the contract plans. 3. Construct a ten (10) foot wide hot oil mix roadway within Well Site Road, between approximate stations 38+00, Line T-1 and 11+00, Line L-1. The surface shall be a minimum of 2" thick, spreader depth, and equal to that surface removed during construction. The resurfacing is esti- mated to consist of approximately 15,000 square feet. Increase in contract price shall be $0.12 per square foot. The quantity constructed shall be as ordered by the Engineer and actual payment shall be based upon measurements approved by the Engineer. Estimated increase in contract price $1,800.00 Increase in contract time 3 days This change is necessitated because this portion of Well Site Road was covered with approximately one foot of dirt during the time when the plans were being prepared and consequently was denoted on the contract plans as being a dirt road within this reach. The balance of the Well Site Road was shown as paved and is not included in this change. 4. Construct the pipeline between 71+00 and 71+90, line No. T-1 of Class 3300 A.C. pipe in lieu of Class 1500 as shown on the contract plans. Increase in contract price $1.70 per lineal foot for ninety (90) feet. $ 153.00 No change in contract time. This change is necessitated because the plans erroneously specified the class of pipe within this reach identical with that specified on each side. SECTION 2. The total amount of increase in the Contract for the above changes is estimated to be $3,680.29. SECTION 3. That NOTICE IS HEREBY GIVEN that the 9th day of May, 1966, at the hour of 7:30 o'clock p.m. in the Council Chambers located in the City Hall, in the City of San Juan Capistrano, California, is the time and place when and where any interested persons having any objections to the proposed changes and modifications proposed to be made may appear before this City Council and show cause why, such changes and modifications should not be made in accordance with this Resolution. Objections must be in writing and filed with the City Clerk in said City not later than the time set for hearing said objections. SECTION 4.
