Resolution Number 65-11-8-2RESOLUTION NO. 65-11-8-2 175 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO ACCEPTING AN EASEMENT DEED AND AUTHORIZING PAYMENT THEREFOR AND PAYMENT OF CROP DAMAGE, ALL IN CONNECTION WITH THE OUTFALL SEWER CONDEMNATION WHEREAS, the City of San Juan Capistrano has heretofore filed its action in the Superior Court of the State of California, in and for the County of Orange, condeming a right-of-way for sewer line and public utility purposes in connection with the building of the outfall sewer facility; and WHEREAS, included within said litigation was a parcel of land, known as Parcel 17, the reasonable value of which the City Council finds to be $5,500, and further finds that it is in the best interests of the City to acquire said parcel for said amount plus a sum in the amount of $731.50 as payment for damage to crops on said parcel 17; and WHEREAS, the owners and the tenant of said Parcel 17 have tendered an ease- ment deed to the City to said Parcel 17 for said sum and the tenant has agreed to accept $731.50 in full settlement of his claim for crop damage; and WHEREAS, it is in the best interests of the City of San Juan Capistrano that it accept said easement deed and authorize the payment of the sums hereinbefore set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano that it accept, and it does hereby accept said easement deed for said Parcel 17, and that it authorize the payment of, and it does hereby authorize the payment of $5,500 to William Thomas Honsberger and Mabel Marie Honsberger, as owners of said Parcel 17, and the sum of $731.50 to premises in full consideration for damage to PASSED, APPROVED and ADOPTED the 8th day ATTEST: City Clerk of the City of San Juan Capistrano STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss CITY OF SAN JUAN CAPISTRANO ) ca as tenant of said said Parcel 17.
