RESOLUTION NO. 65-2-8-1
A RESOLUTION OF THE CITY COUNCIL OF THE CITY -OF
SAN JUAN CAPISTRANO DETERMINING THE NECESSITY FOR,
AND DIRECTING THE ACQUISITION, BY EMINENT DOMAIN,
OF REAL PROPERTY FOR SEWER AND PUBLIC UTILITY PURPOSES
WHEREAS, public convenience and necessity require the acquisition of certain
real property within and without the corporate limits of the City of San Juan
Capistrano for the following purposes, to wit: Right of way for sewer and public
utility purposes and for the installation and the continuing maintenance thereof;
and
WHEREAS, the City Council does find and determine that the public interest
and necessity require the acquisition of all that certain real property herein
described, by the City of San Juan Capistrano as right of way for sewer and public
utility purposes and for the installation and the continuing maintenance thereof.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan
Capistrano that public interest and necessity require the acquisition of an
easement for sewer and public utility purposes in, under, over and through that
certain real property situated within and outside the City of San Juan Capistrano,
in the County of Orange, State of California, more particularly described as follows:
PARCEL 1:
All that certain land situated in the State of California, County or Orange,
Rancho Boca de la Playa, described as follows: Beginning at the intersection of
the southeasterly line of Del Obispo Street, 80.00 feet wide, formerly McKinley
Avenue, as described in a deed to the County of Orange, recorded on April 14,
1926, in Book 636 of Deeds, with a line parallel with and distant southwesterly
500.00 feet, measured at right angles, from the center line of Victoria Avenue,
as described in the deed to the County of Orange, recorded on May 15, 1918, in
Book 324, page 42 of Deeds, said center line being the southerly line of the
Pryor Homestead as described in the Decree recorded in Book 7, page 31 of Home-
steads in the office of the County Recorder of Los Angeles County; thence South
680 54' 35" East 762.05 feet along said parallel line; thence South 100 43' 50"
West 457.46 feet to a line parallel with and distant southwesterly 950.00 feet,
measured at right angles from the center line of said Victoria Avenue; thence

That is included within a strip of land 35.00 feet in width, said strip being
10.00 feet westerly and northerly, and 25.00 feet easterly and southerly of the

Obispo Street (formerly McKinley Avenue) and the California State Highway as
said intersection is shown on a map of Tract No. 932, recorded in Book 29, pages

Capistrano Beach Sanitary District, described as follows: Bounded on the north
by the southerly line of the Pryor Homestead as described in the Decree rendered
June 28, 1888 by the Superior Court of Los Angeles County, California, in the matter
of the Estate of Pablo Pryor, deceased, a certified copy of which Decree was
recorded July 9, 1886 in Book 7, page 31 of Homesteads, Los Angeles County, Califor-
nia, on the east by the westerly line of the right of way of the Atchison, Topeka
and Santa Fe Railroad, on the west by the boundary line described in the agreement
between John 0. Forster and others and Dana's Point Company recorded November 7,
1924, in Book 548, page 113 of Deeds, and on the south by a line parallel to and
500 feet southerly of said southerly boundary of said Pryor Homestead.

BE IT FURTHER RESOLVED that the City Council does hereby find and determine
that public interest and necessity require the acquisition of said easements by the
City of San Juan Capistrano for the aforesaid purposes, and that the taking of the
property hereinabove described is necessary therefor, and that the uses to which
it is to be put are uses authorized by law, and the taking of said property is
necessary to such uses.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the
acquisition of said property by the City of San Juan Capistrano, and the City
Attorney of the City of San Juan Capistrano is hereby directed to institute an
action in eminent domain for the acquisition of the title to said property, and
to perform and carry out all of the necessary proceedings and steps incident to
the acquisition of the title to said property and to obtaining immediate possession
thereof.
