Resolution Number 70-12-21-3r.= d 1 2 31I 4i 5 6 7 8 9 10 11 12 13 14 1S 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 70-12-21-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO AUTHORIZING THE SUBMISSION OF A REQUEST TO THE PUBLIC UTILITIES COMMISSION FOR FUNDS FROM THE CROSSING PROTECTION FUND FOR PROTECTION OF CROSSINGS NO. 2-197.4 DEL OBISPO STREET, 2-197.3 VERDUGO STREET, AND 2-196.2 OSO ROAD AT THEIR INTERSECTIONS WITH THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY AND TRACKS. WHEREAS, the State Public Utilities Commission has ordered certain improvements for the railroad crossings of the Atchison, Topeka and Santa Fe Railway Company and Del Obispo Street, Verdugo Street and Oso Road of the City of San Juan Capistrano under their Decision No. 71563 for Case No. 8102; and WHEREAS, the Atchison, Topeka and Santa Fe Railway Company and the City of San Juan Capistrano have entered into a contract for the improvements to crossing protections at Del Obispo Street (2-197.4); at Verdugo Street (2-197.3); and at Oso Road (2-196.2); all in the City of San Juan Capistrano; and WHEREAS, the legislature of the State of California has created a crossing protection fund for the assistance of local agencies in the construction of crossing protections to be ad- ministered by the Public Utilities Commission; and WHEREAS, the Public Utilities Commission, by its order in Public Utility Commission Case No. 5495, has prescribed that certain information and exhibits be set forth in requests for crossing protection funds, including a resolution from the legisla- tive body of the local agency authorizing the submission of a request for said funds. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano, that a request in conformity with the pro- cedure contained in the order in Public Utility Commission Case No. 5495 be submitted to the Public Utilities Commission, requesting funds from the Crossing Protection Fund for the protection of Crossings No. 2-197.4 Del Obispo Street; 2-197.3 Verdugo Street; and 2-196.2 Oso Road.
