Resolution Number 69-10-13-2165 RESOLUTION NO. 69-10-13-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO URGING THE JUSTICE DEPARTMENT TO SET ASIDE ITS CON- SENT DECREE IN THE AUTOMOBILE MANUFACTURERS ANTI-TRUST ACTION SO THAT FULL PUBLIC TRIAL MAY PROCEED ON THE ANTI -SMOG MATTER. WHEREAS, at long last an anti-trust suit has been brought against the major automobile manufacturers because of their un- warranted and unconscionable delay in developing adequate anti- smog devices for cars; and WHEREAS, during this period the air pollutants in Southern California have finally brought smog to the remote portions of southern Orange County and to San Juan Capistrano as well as to the Summer White House in San Clemente; and WHEREAS, we have been informed that the Justice Department and counsel for the automotive firms have agreed to enter a consent decree under which the manufacturers, without admitting guilt pro- mise to do better in the future; and WHEREAS, the City Council of the City of San Juan Cap- istrano is of the unanimous opinion that the anti-trust suit should be tried at a public trial, not only to afford the suffering public the opportunity to learn the facts involved, but to arrive at a considered decision which might give full impetus to the immediate development of relief from smog. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano that it urge and it does hereby urge the Justice Department of the United States to request that the full trial to the end that the facts surrounding the delay on the part of the automobile manufacturers in developing an adequate anti -smog device or non -smog producing motor vehicle may be brought to public view and that as a result thereof some positive action may be expected. BE IT FURTHER RESOLVED that copies of this resolution be sent to George E. Brown, Member of Congress, the Orange County members of Congress, Honorable John N. Mitchell, Attorney General 16 of the United States and to the Honorable Richard M. Nixon, Pres - dent of the United States.
