Resolution Number 72-12-11-2376' 11 2 3 4 5' 6 7 8 9 10 11 12 13 14 15 17' 18 191 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 72-12-11-2 A RESOLUTION OF THE CITY COUNCIL OF THE;CITY OF SAN JUAN CAPISTRANO SUPPORTING REQUEST OF PARENTS ON POOLS COMMITTEE. WHEREAS, it has been proposed that a County service area be formed which would be contiguous with the boundaries of the Capistrano Unified School District; and WHEREAS, this Council recognizes the need for swimming pools for both the School District and the general public; and WHEREAS, this matter has been approved by the Orange County Local Agency Formation Commission; and WHEREAS, the matter will be considered by the Board of Supervisors; and WHEREAS, this Council is informed that a petition pro- posing the creation of a County service area has been signed by voters in excess of twenty percent (208) of the residents of the Capistrano Unified School District; and WHEREAS, a County service area cannot be formed including area within the City limits without approval of the City Council; and WHEREAS, in the opinion of this Council it would be advantageous to the residents of this City that a County service area be formed providing for construction of two swimming pools to be located on property belonging to the Capistrano Unified School District in Dana Point and San Clemente, NOW, THEREFORE, BE IT RESOLVED that this City Council does hereby consent to the formation of a County service area coterminous with the boundaries of the Capistrano Unified School District, contigent upon the powers of the County service area being limited to the construction of two swimming pools to be located in the Dana Point and San Clemente High Schools of the Capistrano Unified School District, and providing further that monies raised shall not be used for maintenance of said swimming pools. BE IT FURTHER RESOLVED that it is the understanding of this Council that said tax district shall terminate at the end of a two (2) year period.
