RESOLUTION NO. 72-10-9-2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO ESTABLISHING GUIDE-
LINES AND PROCEDURES FOR THE ISSUANCE OF
GRADING PERMITS.
WHEREAS, the City Council of the City of San Juan
Capistrano is deeply concerned about the conduct of grading operations
within the City, particularly with the lasting effects of such opera-
tions which are improperly performed or uncompleted; and
WHEREAS, this City Council deems it necessary to establish
a definitive policy and guidelines for implementation by the Grading
Department of Orange County;
NOW, THEREFORE, BE IT RESOLVED that:
1. When an applicant submits a request for a grading
permit involving 5,000 cubic yards or more of material, such applica-
tion will be processed in the normal manner by the Orange County
Department of Building & Safety - Grading Section. In addition, the
applicant will submit the plan to the office of City Engineer who in
turn will evaluate the application and make a determination as to
the necessity for a specific review and approval by the City Council.
2. The office of the City Engineer, in making its
evaluation of the impact of proposed grading operation, will take into
account the surrounding area, and the need for a critical review due
to its dominant force in changing the overall characteristics of the
terrain.
3. The evaluation by the City Engineer shall also
.relate to those proposals which have had the benefit and review of the
City Planning Commission and/or City Council. In the event the applica-
tion is for a new area that has not received the evaluation relating
to zoning and specific development plans, the matter may also be re-
ferred to the Planning Commission for review and approval.
BE IT FURTHER RESOLVED THAT:
In order to insure full completion the City Council
establishes as a matter of policy that all work to be done under a
grading permit shall have a financial guarantee constituting one
hundred percent of the excavation - embankment operations, one hundred
percent of the drainage facilities, and one hundred percent of erosion
control and landscaping work. Furthermore, the work will be deemed
completed only upon the specific review and acceptance of the work by
the City Council followed by the exoneration of the financial guarantee.

1972, by the following vote, to wit:
