Resolution Number 72-6-12-91 2 3 4 5 6 7 8 9 10 11 12 13 14 15 26 17 28 19 20 $1 82 23 24 as 26 27 gal 19 30 LEI RESOLUTION NO. 72-6-12-9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPLSTRANO, CALIFORNIA CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 22ND DAY OF AUGUST, 1972, FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY A CERTAIN QUESTION, PROPOSITION OR MEASURE RELAT- ING TO THE AUTHORIZATION OF A SEPARATE TAX RATE FOR THE MAINTENANCE, OPERATION AND IMPROVEMENT OF PUBLIC PARK SITES AND THE ESTABLISHMENT OF A DEPARTMENT OF PUBLIC SAFETY WHEREAS, pursuant to the provisions of Article 2, Chapter 3, Division 4 of the Government Code, petitions signed by not less than 10% of the voters of the City of San Juan Capistrano objecting to the adopting of Ordinance 193, submitted to the City Clerk; and WHEREAS, the City Clerk did on June 12, 1972, certify to the City Council that the aforesaid petitions were in compliance with Section 4051.2 of the Government Code; and WHEREAS, it is the desire of this City Council to submit the aforesaid Ordinance to the voters Tuesday, August 22, 1972, in accord- ance with Section 4052 of the Government Code; and WHEREAS, the City Council of the City of San Juan Capistrano also desires to submit to the qualified electors of said city at said election the question, proposition or measure relating to the authori- zation of a separate tax rate for the maintenance, operation and improvement of public park sites hereinafter set forth. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPIS- TRANO DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That pursuant to the requirements of the laws of the State of California relating to a Referendum, there shall be, and there is hereby called and ordered, held in the City of San Juan Capistrnao, County of Orange, State of California, on Tuesday, August 22, 1972, a special municipal election of the qualified electors of said City for the purpose of submitting to them the following question: Shall Ordinance No. 193 of the City of San Juan Capistrano relating to YES NO the Establishment of a Department of Public Safety be adopted? 1 2 3 4 5 H 7 8 9 10 11 12 13', 14 15 16' 17 18 19 20 21 22 23 24 25 261 271 281 29 I 30 311 32 SECTION 2. That said City Council, pursuant to its right and authority to do so, does hereby determine that there shall be, and there is hereby ordered, submitted to the qualified electors of said city at said special municipal election the following question: Shall the City Council of San Juan Capistrano, as authorized by Section YES 5304 of the Public Resources Code, adopt a separate and additional tax rate of .15 cents per $100 assessed valuation for the maintenance, opera- tion and improvements of public park NO sites? SECTION 3. A cross..(+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in the voting square after the word "NO" in the manner herein- before provided shall be counted against the adoption of the question or proposition. SECTION 4. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 5. That the City Clerk of said City is hereby author- ized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and law- fully conduct said election. SECTION 6. That the polls for said election shall be open at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. SECTION 7. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, in- structed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City, and shall make a minute entry of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. SECTION 10. That this resolution shall take effect immediately.
