Resolution Number 72-2-28-1207 RESOLUTION NO. 72-2-28-1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC HEALTH, SAFETY OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON CAMINO CAPISTRANO FROM ORTEGA HIGHWAY TO THE SAN DIEGO GAS & ELECTRIC COMPANY SUBSTATION WHEREAS, Ordinance No. 146 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communi- cation, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called the District, be formed in that area having boundaries described as follows: Camino Capistrano North Boundary - South line of the San Diego Gas & Electric Company substation (North line of Tract 7274); South Boundary - centerline of Ortega Highway; East Boundary - 36 feet East of the centerline of Camino Capistrano from the centerline of Ortega Highway to the centerline of La Zanja Street and 42 feet East of the centerline of Camino Capistrano from the centerline of La Zanja Street to the South line of the SDG&E substation (North line of Tract 7274); West Boundary - 62 feet West of the centerline of Camino Capistrano from the centerline of Ortega Highway to the Westerly prolongation of the South line of the SDG&E substation (Northerly line of Tract 7274). NOW THEREFORE, BE IT RESOLVED as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of San Juan Capistrano on March 27, 1972, at the hour of 7:00 PM in the Council Chambers of the City offices, 32400 Paseo Adelanto, San Juan Capistrano, California, to ascertain whether the public health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the under- ground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. 208. 4, The area proposed to be included in the District is shown upon that certain map entitled Exhibit "A", dated March, 1972, which is on file in the office of the City Clerk of the City of San Juan Capistrano.
