RESOLUTION NO. 71-11-22-4
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO SUPPORTING THE CITY OF LOS
ANGELES IN ITS EFFORTS TO MAINTAIN LOCAL CONTROL
OF THE ADMINISTRATION OF LOCAL BUILDING CODES
WHEREAS, the promulgation, adoption and administration of
building and safety codes are uniquely a matter of local concern; and
WHEREAS, it has taken years of effort and experience at the
local level to devise and implement a systematic code of building and
safety regulations which promote the best interests of the public.
WHEREAS, deliberate and considered changes to a system of
building regulations and codes can be made only after careful analysis
of the benefits compared to the safety of the public; and
WHEREAS, the federal Department of Housing and Urban Develop-
ment has reportedly demanded that the City of Los Angeles, without its
consent, make all -considered changes to vital parts of its electrical
code allowing the substitution of plastic sheathed wiring in place of
metal conduit.
WHEREAS, this demand represents dangerous tampering by a
distant and unqualified agency of the federal government with vital
safety measures which have long been matters of exclusive local concern.
NOW THEREFORE, BE IT RESOLVED that the City of San Juan
Capistrano urge the City of Los Angeles to maintain its legitimate
resistance to interference from federal agencies in matters expressly
of local concern.
BE IT FURTHER RESOLVED, that the federal Department of Housing
and Urban Development be requested to find methods of strengthening
local government services and safety measures through assistance to
cities and counties rather than arbitrarily requiring selective changes
in those portions of local rules and regulations designed for the public's
safety which it chooses to disagree with.
BE IT FURTHER RESOLVED that copies of this resolution be sent
to the City Clerk to the City of Los Angeles, United States Senators,
Representative John Schmitz, and the Los Angeles Area Office of the
Department of Housing and Urban Development.
PASSED, APPROVED and ADOPTED this 22nd day of November, 1971
at a regular meeting of the City Council of the City of San Juan Capistrano
by the following vote, to wit:
