RESOLUTION NO. 71-6-28-2
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO ESTABLISHING POLICY FOR THE
CONTROL OF PLACARDS AND SIGNS IN THE PUBLIC
RIGHTS OF WAY
WHEREAS, this Council is desirous of keeping the public rights
of way free and clear of distracting visual clutter; and
WHEREAS, Council is nevertheless confident that said rights
of way can be properly used on a limited and regulated basis for the
placement of certain signs, placards and posters.
NOW THEREFORE, BE IT RESOLVED that this Council does hereby
adopt the following rules and regulations for the placement of placards,
posters and stake -out signs in the public rights of way:
1. No placard, poster or stake -out sign, hereinafter called
"signs", shall be placed in any public right of way by any person with-
out first having obtained an encroachment permit from the Director of
Public Works.
2. Each such application shall be accompanied by a cash
deposit of $100 which shall be forfeited if the rules and regulations
herein contained are not strictly met.
3. Where signs are utilized for the purpose of advertising
or giving direction to property offered for sale, lease or rent such
property must be located within the City of San Juan Capistrano.
4. All signs shall not exceed six square feet in size nor
shall they be placed with the top thereof standing more than three
feet above ground level.
5. Signs may be displayed on weekends only, no earlier than
4:00 PM on Friday, and shall be removed no later than 6:00 PM on Sunday.
6. The location, spacing and number of signs shall be at the
discretion of the Director of Public Works and shall be based upon
aesthetics, as well as public safety, interest and convenience.
7. Where such signs are used periodically for the sale, lease
or control of real property, encroachment permits shall be issued only
for such periods as the permittee maintains an on -premises sales office
and shall terminate when 90 per cent of property or structures being
advertised have been sold, leased or rented.
8. The violation of any of these rules and regulations may
result in the termination of the encroachment permit by the Director of
Public Works for a period not less than 30 nor more than 90 days.
9. Any rulings and decisions of the Director of Public Works
may be appealed to the City Administrator.
PASSED, APPROVED and ADOPTED this 28th day of June, 1971 at
a regular meeting of the City Council of the City of San Juan Capistrano,
by the following vote, to wit:
