RESOLUTION NO. 71-6-14-3
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO OPPOSING ASSEMBLY BILL NO.
1471
WHEREAS, Assembly Bill No. 1471 purports to preserve
California's coastline through the control of the development of
I adjacent land within a "coastal zone"; and
WHEREAS, the aforesaid Bill defines coastal zone as the
"land and water area of the State of California from the border of
the State or Oregon to the border of the Republic of Mexico, extend-
ing seaward to the outer limit of state jurisdiction, . . . . and
extending inland to the highest elevation of the nearest coastal
mountain range . . . but such inland boundaries shall not extend
beyond the highest elevation of the nearest coastal mountain range

for five miles from the mean high tide line, whichever is the shortest
distance ."; and
WHEREAS, the aforesaid Bill will create a state commission
with the power to determine land use and development within the
boundaries of cities and other local agencies and could thus infringe
upon the right of cities and other local agencies to determine and
regulate land use and development within their boundaries; and
WHEREAS, the City of San Juan Capistrano is vitally con-
cerned with the preservation of the coastline in South Orange County
and the development of the coastal areas adjacent thereto.
NOW THEREFORE, BE IT RESOLVED that the City Council of the
City of San Juan Capistrano hereby opposes the enactment of Assembly
Bill No. 1471 for the following reasons:
1. It is their belief that coastlines can be better
preserved and protected by the cities and local agencies concerned
and involved directly therewith;
2. It is their desire to have full power and control over
the planning and development of coastal areas lying within their
territorial jurisdiction, and the formation of the California Coastal
32JI Zone Conservation Commission with power to issue permits for land

development within that area would constitute an infringement upon
that right;
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to transmit copies of this resolution to
appropriate state Legislators, specifically the Chairman of the
Assembly Committee on Planning and Land Use, the League of California
i
Cities, and the Orange County Board of Supervisors.
PASSED, APPROVED and ADOPTED by the City Council of the
City of San Juan Capistrano at a regular meeting thereof held on the
14th day of June, 1971 by the following stated vote, to wit:

NOES: COUNCILMEN: NONE
