Resolution Number 76-2-4-4407 RESOLUTION NO. 76-2-4-4 PRIMA DESHECHA - GENERAL PLAN COMPLIANCE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CERTIFYING THAT THE ACQUISITION OF LANDS FOR THE PRIMA DESHECHA PROJECT COMPLIES WITH THE CITY'S GENERAL PLAN WHEREAS, the County of Orange is the lead agency for a project known as "Prima Deshecha Recreation/ Disposal Area"; and WHEREAS, the implementation of the project requires the acquisition of land within the municipal limits of San Juan Capistrano; and WHEREAS, Section 65402 of the Government Code requires a determination of General Plan compliance in such a situation. NOW, THEREFORE, BE IT RESOLVED, that based on the following considerations, the City of San Juan Capistrano finds the acquisition of land within its municipal limits for the Prima Deshecha Recreation/Disposal Area to be in compliance with the City's General Plan. The considerations are: 1. That the intended long-term use of the Prima Deshecha property is for regional recreation/open space purposes; 2. That the site will be used prior to recreational development by the County for a solid waste sanitary landfill. It is also planned to continue landfill use concurrently with recreational use after the latter is initiated. When the landfill has been completed, it will be used in its entirety for a park/recreation area; 3. That landfill operations will, in general, be confined to a line approximately 50 feet below the existing ridgeline. In cases of extenuating circumstances, this limit would be reduced. Cover material for the wastes will be excavated from within the site, augmented by like materials hauled into the site for disposal by others; 4. That the City shall be consulted and participate in the planning of the total site, including both recreation and disposal uses; 5. The County shall comply with zoning and land use regulations and procedures as they apply to the interim and permanent uses. BE IT FURTHER RESOLVED that the City Clerk be, and is hereby directed to forward this Resolution to the Orange County Board of Supervisors and the Orange County Environmental Management Agency.
