Resolution Number 75-12-3-2RESOLUTION NO. 75-12-3-2 317 CALLING ELECTION FOR MARCH 2, 1976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 2nd DAY OF MARCH, 1976, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES AND FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY OF A CERTAIN QUESTION, PROPOSITION OR MEASURE RELATING TO THE PRESERVATION OF AGRICULTURE AND OPINION QUESTIONS RELATING THERETO WHEREAS, under the provisions of the laws relating to general law cities in the State of California, a regular general municipal election shall be held on the 2nd day of March, 1976, for the election of two (2) members of the City Council of said City for the full term of four years; and WHEREAS, the City Council of the City of San Juan Capistrano also desires to submit to the qualified electors of said City at said election the question proposition or measure relating to the preservation of agriculture hereinafter set forth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State, there shall be, and there is hereby called and ordered, held in the City of San Juan Capistrano, County of Orange, State of California, on Tuesday, the 2nd day of March, 1976, a regular general municipal election of the qualified electors of said City for the purpose of electing two (2) members of the City Council of said City for the full term of four years. SECTION 2. That said City Council, pursuant to its right and authority so to do, does hereby determine that there shall be and there is hereby ordered submitted to the qualified electors of said City at said regular general municipal election the following question, to wit: PROPOSITION A In order to provide primary financing for an open space conservation and agricultural perpetuation program, should the City annually levy a property tax of 10� per $100 of YES assessed valuation and a fee on new con- struction of $500 per residential unit and $2000 per acre for commercial, industrial, and institutional construction? Land shown in the Open Space and Conservation Element of the General Plan as "Open Space Areas for NO Resource Conservation and Production" shall be eligible for acquisition by the City to implement the program. -1- OPINION QUESTIONS VOTE FOR ONE The City should undertake a more aggressive open space conservation and agricultural perpetuation program than that described in Proposition A. However, the amount of property tax allocated to the program should not exceed the annual rate of 20Q per $100 of assessed valuation. 2. The City should implement an open space conservation and agricultural perpetua- tion program only to the extent described in Proposition A. 3. The City should implement an open space conservation and agricultural perpetua- tion program but should not levy an annual property tax for that purpose. 4. The City should not implement an open space conservation and agricultural perpetuation program financed by City funds. -2- 327- A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. A cross (+) placed in the voting square adjacent to any one of the four (4) Opinion Questions in the manner hereinbefore provided shall be counted in favor of that one Opinion Question. SECTION 3. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 4. That the City Clerk of said City is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. That the polls for said election shall be open at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until eight o'clock P.M. of the same day, when said polls shall be closed, except as pro- vided in Section 14436 of the Elections Code of the State of California. SECTION 6. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 7. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. SECTION 9. That this Resolution shall take effect immediately.
