Resolution Number 75-11-26-3307 RESOLUTION NO. 75-11-26-3 IMMIGRATION SERVICE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, EXPRESS- ING CONCERN FOR THE CONSTITUTIONAL AND HUMAN RIGHTS OF PERSONS SUBJECT TO SCRUTINY AND SURVEILLANCE OF THE UNITED STATES IMMIGRATION AND NATURALIZATION SERVICE WHEREAS, the City Council of the City of San Juan Capistrano is informed and believes that there have been frequent and indiscriminate harrassment of "Mexican -appearing" persons throughout the County of Orange by members of the United States Immigration and Naturalization Service; and WHEREAS, this City Council firmly espouses the follow- ing inviolate principles: a. That the enforcement of existing laws must lie within a framework of constitutional rights of the individual; b. Persons must not be made to suffer repression due to national origin; C. There must be due process in the policies of immi- gration officers in their acts of search and detention; d. There should be better communication between border patrol officers and the City administration; the City Manager should be directed to accept and forward compliants pertaining to harrassment and unseemly force in the carrying out of the law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano that actions of the United States Immigration and Naturalization Service which contravene the fore- going basic human rights should not be tolerated and are hereby condemned. BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to send copies of this Resolution to the Director of the Immigration Service in Washington, D.C.; to Mr. Sureck, the Los Angeles Director; and, to our State and National legislators.
