RESOLUTION NO. 75-9-10-1
GRANTING EXEMPTION FROM DEFERRAL PERIOD
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, GRANTING
EXEMPTION TO DAVID MURALT, FOR PROPOSED
COMMERCIAL -MANUFACTURING USE, FROM THE PRO-
VISIONS OF ORDINANCE NO. 265, AS AMENDED
WHEREAS, the City Council has heretofore adopted Ordi-
nance No. 265 deferring the acceptance of certain applications
relating to uses of land; and
WHEREAS, the aforesaid Ordinance provides for the
consideration of exemptions by the City Council on a case-by-
case basis; and
WHEREAS, David Muralt has requested such an exemption
for commercial -manufacturing development along Camino Capistrano
south of San Juan Creek Road; and
WHEREAS, upon a hearing duly had and held, the City
Council has found and determined that the aforesaid request is
meritorious and, if an exemption is not granted will cause hard-
ship upon the applicant not generally applicable to other
affected parties.
NOW, THEREFORE, BE IT RESOLVED, that the request of
David Muralt for exemption from the deferral period established
by Ordinance No. 265, as amended, be and is hereby granted and
the applicant shall be permitted to process its plans in accordance
with the Land Use Management Code; the application shall, moreover,
not be effected until the LUMC is in full force.
PASSED, APPROVED AND ADOPTED this 10th day of September,
1975, by the following vote, to wit:
AYES: Councilmen Byrnes, Heckscher, Nash, Sweeney,
and Mayor Weathers
