Resolution Number 75-6-4-2RESOLUTION NO. 75-6-4-2 GRANTING EXEMPTION FROM DEFERRAL PERIOD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, GRANTING EXEMPTION TO D. D. HAHN FOR PROPOSED RESIDENTIAL DEVELOPMENT FROM THE PROVISIONS OF ORDINANCE NO. 2651 AS AMENDED WHEREAS, the City Council has heretofore adopted Ordi- nance No. 265 deferring the acceptance of certain applications relating to uses of land; and WHEREAS, the aforesaid Ordinance provides for the consideration of exemptions by the City Council on a case-by- case basis; and WHEREAS, D. D. Hahn has requested such an exemption for the development of three and one-half more or less acres at Calle Lucana for residential purposes; and WHEREAS, upon a hearing duly had and held, the City Council has found and determined that the aforesaid request is meritorious and, if an exemption is not granted will cause hardship upon the applicant not generally applicable to other affected parties. NOW, THEREFORE, BE IT RESOLVED, that the request of D. D. Hahn for exemption from the deferral period established by Ordinance No. 265, as amended, be and is hereby granted and the applicant shall be permitted to process its plans in accordance with the Land Use Management Code; the application shall not moreover, be effective until the LUMC is in full force.
