Resolution Number 76-11-3-3375 RESOLUTION NO. 76-11-3-3 WAIVER OF DEVELOPMENT PHASING (CRAIG/MEREDITH) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING A REQUEST FOR RELIEF FROM THE PROVISIONS OF ORDINANCE NO. 308 FOR TENTATIVE TRACT 8087 WHEREAS, Craig Development Corporation has applied for relief from the provisions of Ordinance No. 308, which imposes a building permit phasing schedule for Tentative Tract 8087 and other approved subdivisions in the City; and WHEREAS, the City Council has made the following find- ings relative to the requested modification of the phasing schedule: 1. There is a continuing problem of traffic and pedestrian safety, resulting from construction traffic on Via de Agua extending through existing residential neighborhoods to the project site. This problem goes beyond the usual nuisances and inconveniences typically associated with construction activities. The City Council and various City Commissions have previously noted the problems of traffic safety in the area. 2. The hazards associated with construction traffic can be more quickly eliminated if the subject project is com- pleted at the earliest possible date. To this end, all remaining building permits for Tentative Tract 8087 should be allocated for issuance within the first phasing period, that is prior to January 1, 1978. 3. Ordinance No. 308 is a temporary urgency ordinance which will expire in January 1977. At that time, these growth man- agement requirements will be thoroughly reviewed within the con- text of the City's entire growth management program. Modifications may be made, if deemed necessary, at that time. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve the requested modification of Ordinance No. 308 for Tentative Tract 8087 and the remaining 65 building per- mits shall be issuable prior to January 1, 1978.
