Resolution Number 76-10-20-2RESOLUTION NO. 76-10-20-2 347 GENERAL PLAN AMENDMENT 76-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, TAKING ACTION ON GENERAL PLAN AMENDMENT 76-2 WHEREAS, the following items were included in General Plan Amendment (GPA) 76-2: A. McCracken Hill - Request for change in land use designation from 2 to 1 unit per acre maximum residential density. This item was withdrawn from GPA 76-2 by the City Council at its July 21, 1976 meeting. Therefore, there is no action on this item. B. Duque - Request for change in land use designa- tion from 1 to 2 units per acre maximum residential density; study area located west of Aguacate Road. C. Swanner - Request for change in land use designa- tion from Recreation Commercial to Quasi -Industrial. Area is 18+ acres on Rancho Viejo Road south of Mission Hills Drive. Change requested to accommodate auto dealership on approximately 6 acres within the study area. D. Alto Capistrano Access - City -initiated Amendment to determine an alternate access route or routes for the Alto Capistrano area. E. Prudential Shopping Center - Request for change in land use designation from Neighborhood Convenience Center to General Commercial. Approximately 14 acres located on Camino Las Ramblas opposite Via California. and, WHEREAS, the City's Environmental Review Board reviewed the proposed Amendments and made the following deter- minations: Item B (Duque) - Environmental Impact Report required, Item C (Swanner) - Environmental Impact Report required. Item D (Alto Capistrano Access) - Environmental Impact Report previously prepared for Route "E" access study. This EIR was deemed adequate for the present Amend- ment, subject to the requirement for specific environ- mental assessment of any new access routes proposed for consideration. Item E (Prudential Shopping Center) - Environmental Impact Report previously prepared for project deter- mined to be adequate subject to submission of additional information on economics and view analysis. The preceding environmental impact reports have been reviewed by the Environmental Review Board and the Planning Commission and determined to be adequate. The reports have also been reviewed by the City Council which, after taking public testimony on the EIRs, have certified them as adequate; and, WHEREAS, the Planning Commission and City Council have held duly -advertised public hearings, received public testimony, reviewed staff reports, EIRs, and other relevant material concern- ing the petitions, and considered all of the above in light of the goals and policies of the General Plan; and, WHEREAS, the City Council has found and determined as follows concerning the various items in GPA 76-2: -1- 1. Item B (Duque) 349 A. The adverse environmental impacts of the increase in maximum residential density within the subject property or the study area as a whole are not justified by any considerations of hardship or overriding benefits; B. The established character of the study area would be adversely affected by any increase in maxi- mum residential density for all or any part of the area. 2. Item C (Swanner) A. The proposed Quasi -Industrial designation could create pressures for similar changes in other areas of the City. This would lead to a dispersion of commercial -industrial land uses in conflict with the goals and policies of the General Plan and the Citizens' Policy Plan; B. The proposed land use change and similar changes influenced by the Amendment would adversely affect the visual image of the City as seen from the freeway; C. The existing Recreation Commercial designa- tion already provides a reasonable range of develop- ment options for the properties; D. The General Plan background studies of land allocation needs, land absorption rates, and market demand determined that the location and acreage of property already designated Quasi -Industrial is sufficient; E. The creation of a Quasi -Industrial designa- tion on the subject properties could create unaccept- able conflicts with nearby low density residential uses. 3. Item D (Alto Capistrano Access) A. Possible access routes from the Meredith tract to the north are not economically or physically reasonable alternatives. B. Construction of Route "E" to the south of the Meredith tract or Route "D" over Window Hill, would not, by themselves, correct the Alto Capistrano access problems. C. Construction of Routes "D" and "E" together could work effectively to correct the access problems if traffic control measures (such as a diverter or cul-de-sac) were installed at Via de Agua and Avenida Calita upon completion of Routes "D" and "E". 4. Item E (Prudential Shopping Center) A. The proposed 14 -acre shopping center is con- siderably larger than the scale of "approximately 4 to approximately 8 acres" specified in the General Plan for satellite shopping centers outside of the City's central business district; B. Development of a shopping center larger than the 4-8 acre standard could detract from the vitality of the central business district. Approval of such a change would be contrary to the General Plan policy of concentrating larger scale general commercial uses in the downtown area. -2- 351 NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby take the following actions on General Plan Amend- ment 76-2: 1. Denial of GPA 76-2B (Duque) and retention of the existing Very Low Density Residential (maximum one residential unit per acre) land use designation; action taken on this item by the following vote: AYES: Councilmen Friess, Heckscher and Mayor Nash NOES: Councilmen Sweeney and McDowell 2. Denial of GPA 76-2C (Swanner) and retention of the existing Recreation Commercial land use designation; action taken on this item by the following vote: AYES: Councilmen Friess, Heckscher and Mayor Nash NOES: Councilmen Sweeney and McDowell 3. Approval of GPA 76-2D (Alto Capistrano Access) to include the following: a. Designation of Route "E" on the Composite Land Use Map as a required commuter. b. Designation of Route "D" on the Composite Land Use Map as a required commuter. C. Elimination of the ridgeline protection designation south of the Meredith tract to the extent necessary to accommodate Route "E". d. Relocation of the local park designation for Alto Capistrano to the vicinity of the intersec- tion of Avenida Calita and Camino Las Ramblas. Action taken on this item by the following vote: AYES: Councilmen Friess, Heckscher, McDowell, Sweeney and Mayor Nash NOES: None 4. Denial of GPA 76-2E (Prudential) and retention of the existing land use designations. A motion to approve a change in land use designation was defeated, thus resulting in a retention of the existing designations.
