RESOLUTION NO. 76-9-1-4
SEWER CONNECTION CHARGES AND SERVICE CHARGES
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO REPEALING RESOLUTION
NO. 65-6-14-2 ESTABLISHING THE CHARGES TO BE
MADE FOR ANY AND ALL SEWAGE DISPOSAL CONNECTIONS
WITH THE PUBLIC SEWERAGE SYSTEM, ESTABLISHING
MAIN EXTENSION CHARGES AND SEWER SERVICE CHARGES
WITHIN THE CORPORATE LIMITS OF THE CITY OF SAN
JUAN CAPISTRANO AND AREAS BECOMING PART OF THE
CITY FROM AND AFTER SEPTEMBER 1, 1976.
WHEREAS, Ordinance No. 63 of the City of San Juan Capistrano,
adopted March 25, 1963, as amended by Ordinance No. 106, adopted
May 24, 1965, authorizes the City Council of the City of San Juan
Capistrano to establish from time to time, by resolution, the
charges to be made for any and all disposal connections, service
charges and main extension charges in areas within the City of San
Juan Capistrano; and
WHEREAS, after due consideration, the City Council finds and
determines that Resolution No. 65-6-14-2, adopted by the City
Council on July 1, 1965, should be repealed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of San Juan Capistrano that said Resolution No. 65-6-14-2, and the
same is hereby repealed to read as follows:
"A. Sewer Connection Charges
111. Single Family Dwelling Unit - Any single family
living unit with kitchen facilities whether occurring
as a residence, multiple dwelling, motel room (with kitchen)
trailers, etc.
112. Non-residential, including commercial, industrial,
public buildings, schools, churches, motels and hotels
(without individual kitchen facilities.)
For each 1500 sq. ft. of interior floor area or fraction
thereof ... $750.00.
113. The connection charge will be $750.00 for residential
units
114. Payment of charges - For subdivisions the sewer con-
nection charge shall be paid prior to and as condition of
approval of the final subdivision map. All other sewer
connection charges shall be paid prior to and as a condition
precedent to permission to connect to the public sewerage
ystem.11
115. Charges subject to review - Whenever in the opinion of
the City Council the sewage discharge from a non-residential
connection may exceed a flow of 7500 cu. ft. per month per
acre of connected premises,it may increase the sewer con-
nection charge."
11B. Main Extension Charges
111. Application of charge - Main Extension charges shall
apply to all areas within the City not presently served
with the public sewerage system and not subsequently included
in the area of a sewer assessment district."
112. Main extension charge - A charge of $100 per acre will
be made for all subdivisions where in -tract sewers are
included."

113. Direct connection main extension charge - a charge
of $250 will be made for each premise connecting directly
to one of the City sewers."
114. Escalation of charge - Main extension charges will
increase by 10% of the amount of the initial charge on the
1st day of each July, that began July 1, 1966, unless the
City Council in each year shall, by resolution, prior to
May 31 of each year waive such increase for the next ensuing
fiscal year."
115. Disposition of charges - Funds collected as sewer main
extension charges shall be used only for the extension of
the sewer system."
"C. Sewer Service Charge
111. Basic monthly charge - Each residential premise connected
to the public sewerage system - $4.50 per month, per single
family living unit payable in advance. Each non-residential
premise connected to the public sewerage system - $4.50 per
water meter."
112. Quantity Charge - Wherever any premise connected to
the public sewerage system is served by a water meter of 1"
size or larger an additional charge shall be made measured
by water consumption at the rate of $0.03 per 100 cubic
feet of water consumed in excess of 3,000 cubic feet per
month."
"3. Charge for trailers - Wherever trailers are connected
to the public sewerage system a monthly charge of $1.00 shall
be made for each such trailer."
AND, BE IT FURTHER RESOLVED that the effective date of this
Resolution shall be October 1, 1976.

following vote, to wit:
