Resolution Number 76-7-7-7RESOLUTION No. 76-7-7-7 GENERAL PLAN AMENDMENT 76-1, ITEM A (MISSION HILLS RANCH, INC.) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DENYING PETITION FOR GENERAL PLAN AMENDMENT 76-1 A (MISSION HILLS RANCH, INC.) WHEREAS, the applicant, Mission Hills Ranch, Inc., has petitioned the City for an amendment to the General Plan for a change in the land use designations on 157+ acres located east of the existing Mission Hills Ranch development; and, WHEREAS, the City's Environmental Review Board has reviewed the proposed amendment and determined that the environmental impact report prepared for the initial petition, processed with General Plan Amendment 75-1, is adequate subject to the submission of certain supplementary studies. Said studies, involving a biological survey, the effect of the proposed project on adjacent agricultural uses, and a study of alternate access alignments, were submitted and have been accepted by the Environmental Review Board as adequate. All requirements of the California Environmental Quality Act and the City's Environmental Impact Report Guidelines have been met; and, WHEREAS, the Planning Commission and the City Council have held duly advertised public hearings, received public testimony, reviewed staff reports and other relevant material concerning the petition, and considered all of the above in light of the goals and policies of the General Plan; and, WHEREAS, the Planning Commission, on June 22, 1976, did further review the proposed General Plan Amendment and did reaffirm its recommendation for denial; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1, The applicant's petition would result in residential densities incompatible with those existing or planned for adjacent areas surrounding the subject property for considerable distances in all directions; 2. The existing land use designations on the subject property, as adopted by General Plan Amendment 75-1, are (a) compatible with the character of existing and planned development in surrounding areas; and (b) consistent with the goals and policies of the General Plan. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny the applicant's petition for General Plan Amendment 76-1 A.
