RESOLUTION NO. 77-6-15-2
UNDERGROUND UTILITY ADVISORY COMMITTEE
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, FORMING
AN UNDERGROUND UTILITY ADVISORY COMMITTEE
WHEREAS, the City of San Juan Capistrano desires to
underground all overhead utilities along Camino Capistrano
between Forster Street and Avenida Padre and a portion of
Del Obispo Street west of Camino Capistrano; and,
WHEREAS, the City has determined that the undergrounding
of overhead utilities would be in the best public interest for
reasons of safety as well as scenic interest through a civic area.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of San Juan Capistrano as follows:
SECTION 1. There is hereby established an Underground
Utility Advisory Committee.
SECTION 2. The Committee shall consist of the following
members:
Director of Public Works
Director of Planning
One representative from the electric utility
One representative from the telephone utility
One representative from each of the cable
television companies
SECTION 3. The Committee shall be governed by the
following procedures and rules:

a. The Director of Public Works shall be the Chairman
of the Committee.
b. The Committee shall meet on a semiannual basis
or at the call of the Chairman.
SECTION 4. The duties of the Committee shall be as
a. Survey the community to determine "Areas affected
by General Public Interest" in which lines should
be placed underground.
b. Develop a priority list of projects to be done and
establish a tentative master plan to be approved
by the City Council.
C. Prepare detailed information on costs, proposed
underground district boundaries, construction
schedules, methods of financing, and recommended
City Council action for projects on which the City
Council has indicated a desire to proceed under
the adopted master plan.
d. Periodically review the master plan and suggest
changes to the City Council when it appears such
changes are warranted.
e. Review requests for time extensions with respect
to the completion of specific projects in
underground districts and make recommendations to
the City Council.

f. Develop procedures and recommendations for use
by the appropriate City Departments and utilities
to promote the timely completion of underground
projects.
g. Periodically prepare a report to the City Council
indicating the status of the City's underground
program.
SECTION 5. Nothing herein contained shall give said
Committee the power or authority to bind the City to any course
of action. All reports and recommendations of the Committee
shall be advisory to the City Council. Notwithstanding the
creation of this Committee or any provision of the Resolution
to the contrary, it is the intent of this Resolution that the
City Council may, in any case it deems appropriate, make final
decisions and determinations even though said Committee has not
reported to the City Council on the matter involved in said final
decision or determination.

June , 1977, by the following vote, to wit:

and Mayor Heckscher
