RESOLUTION NO. 77-2-2-5
ENDORSING PARK BOND ACT PRIORITY PLAN OF EXPENDITURE
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, ENDORSING
THE PRIORITY PLAN FOR EXPENDITURES FOR JURIS-
DICTIONS WITHIN THE COUNTY OF ORANGE FROM THE
NEJEDLY-HART STATE, URBAN, AND COASTAL PARK
BOND ACT OF 1976
WHEREAS, Senate Bill 3121 approved by the Governor of
the State of California on June 24, 1976, created the Nejedly-
Hart State, Urban, and Coastal Park Bond Act of 1976; and
WHEREAS, the voters of the State of California on
November 2, 1976, adopted the Nejedly-Hart State, Urban and
Coastal Park Bond Act of 1976 and authorized the issuance of
bonds in the amount of $280 million to provide funds to acquire,
develop, and restore real property for state and local park,
beach, recreational and historical purposes; and
WHEREAS, approximately $6.9 million of these funds
will be available for use by Orange County and its cities and
districts for the acquisition and development of high priority
projects; and
WHEREAS, Section 5096..127 of the Public Resources Code
requires that each County of the State submit a priority plan of
expenditures to the State Department of Parks and Recreation
prior to June 30, 1978; and
WHEREAS, the plan must be approved by at least 50
percent of the cities and districts within the County represent-
ing at least 50 percent of the population of the cities and
districts, and by the County Board of Supervisors; and
WHEREAS, similar provisions were required for State
Beach, Park, Historical and Recreational Facilities Bond Act of
1974 and after numerous meetings more than 50 percent of the
jurisdictions and representing more than 50 percent of the popu-
lation agreed that the expenditure plan should provide approxi-
mately 29 percent of the available funds to Orange County in
recognition of its regional park responsibility as well as its
local park responsibility and the remaining 71 percent be made
available to cities and districts on an equal per capita basis
except that no jurisdiction would receive less than $10,000; and
WHEREAS, the Orange County Division, League of Califor-
nia Cities, Ad Hoc Task Force for Proposition #2 met January 14,
1977, and adopted the attached priority plan for expenditures by
unanimous vote; and
WHEREAS, the population figure for the City of San Juan
Capistrano has been revised according to latest census estimates.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano, California, hereby approves
the priority plan for expenditures for Orange County as identi-
fied above. Said plan is attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED this 2nd day of February,
19772 by the following vote, to wit:
AYES: Councilmen Sweeney, McDowell, Friess,
Heckscher, and Mayor Nash

Proposed Priority Plan of Expenditures
1976 State Bond Act
Based upon the 1976 Special Census, the estimated $6.9 million
of 1976 State Bond Act monies have been allocated using the
ratio of city population to County population after allocating
$2 million to the County Regional Park Program.

have supplied a 1976 estimated population based on a census
performed in 1973 or 1974.

revised figures are based on the issuance of 648 occupancy
permits which were issued of single family dwellings with an
average of 3.3 persons per permit.
