Resolution Number 77-2-2-371 RESOLUTION NO. 77-2-2-3 HISTORICAL BUILDING CODE ENFORCEMENT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REQUEST- ING COUNTY ENFORCEMENT OF THE HISTORICAL BUILDING CODE WHEREAS, the City of San Juan Capistrano is the seventh oldest community in the State of California and there- fore has a unique cultural heritage worthy of being preserved for future generations; and, WHEREAS, this heritage is exemplified by surviving structures from various historical periods which have been placed on an inventory of historical and cultural landmarks; and, WHEREAS, the Uniform Building Code currently in use does not differentiate between landmark structures and other structures; and, WHEREAS, the statutes of the State of California provide alternative building regulations for qualified histori- cal structures which are to be restored or rehabilitated; and, WHEREAS, the Orange County Building and Safety Department, acting as the agent of the City, has agreed to enforce the State Historical Building Code in San Juan Capistrano if the City directs them to do so. NOW, THEREFORE, BE IT RESOLVED that the City of San Juan Capistrano requests that the State Historical Building Code, identified as Section 104J of the 1976 Uniform Building Code, be enforced in San Juan Capistrano until the entire 1976 Uniform Building Code is adopted by the County and the City.
