Resolution Number 78-2-1-6167 RESOLUTION NO. 78-2-1-6 AGRICULTURAL PRESERVATION CONTRACT (COLE) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING THE ESTABLISHMENT OF AN AGRICULTURAL PRESERVE UNDER THE PROVISIONS OF THE LAND CONSERVATION ACT OF 1965 OF THE STATE OF CALIFORNIA FOR A 3.4+ ACRE PARCEL LOCATED ON LOS CERRITOS AVENUE WHEREAS, the applicant, Jarold B. Cole, 31501 Los Cerritos Avenue, San Juan Capistrano, California, has submitted an application of intent to enter into an Agricultural Preser- vation Contract under the provisions of the State of California Land Conservation Act of 1965 (as amended) for a 3.4+ acre parcel identified as Assessor's Parcel No. 650-151-12; and, WHEREAS, the City Council by Resolution No. 77-7-20-6 has indicated its desire to enter said contracts in order to preserve agricultural operations within the community; and, WHEREAS, the Environmental Review Board has reviewed the application and determined that it would not have a significant impact on the environment and has issued a Negative Declaration, and has otherwise carried out the applicable provisions of the California Environmental Quality Act of 1970; and, follows: WHEREAS, the City Council finds and determines as 1. The continued agricultural operations will be internally consistent with and implement one of the major goals of the General Plan which is the long-term preservation of agricultural uses. 2. The continuation of the existing agricultural use will not create any adverse environmental impacts upon adjacent land uses. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve the request to establish an agricultural preserve under provisions of the California Land Conservation Act of 1965 (as amended), and authorizes the Mayor to execute all necessary documents required for the establishment of said preserve.
