Resolution Number 78-2-1-1149 RESOLUTION NO. 78-2-1-1 ESTABLISHMENT OF USES AND DEVELOPMENT STANDARDS (DEL OBISPO LAND CORPORATION) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING PERMITTED USES AND DEVELOPMENT STANDARDS UNDER PROVISIONS OF ORDINANCE NO. 290 FOR ASSESSOR'S PARCEL NOS. 121-160-25, 121-160-34, AND 121-160-35 WHEREAS, the applicant, Del Obispo Land Corporation, 424 North El Camino Real, San Clemente, California, has requested a determination of use for a 1.0+ acre parcel within the Los Rios Precise Plan study area specifically identified as Assessor's Parcel Nos. 121-160-25, 121-160-34, and 121-160-35 per provisions of Ordinance No. 290; and, WHEREAS, the Environmental Review Board has determined that the Los Rios Precise Plan may have a significant impact on the environment and has caused an Environmental Impact Report to be prepared, and has otherwise carried out all requirements of the California Environmental Quality Act of 1970; and, WHEREAS, the City's Planning Commission has reviewed the request and has forwarded it to the City Council recommending a list and permitted uses subject to specific development standards; and, WHEREAS, a public hearing has been duly advertised and held to receive public testimony on the applicant's request. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby determine that the following uses may be permitted for the subject property: Principal Uses Permitted 1. Medical or dental offices. 2. General Office uses such as business, professional, real estate, travel agencies, and similar office uses, including banks, savings and loan associations, or credit unions. 3. Retail sales of storage of plants, trees, shrubs and other nursery items; farmers' market items such as fruits and vegetables sold from temporary open air stands; arts and crafts display and sales; outdoor ceramics. 4. Non -retail uses such as greenhouse, crop and tree farming, wholesale nursery. 5. Conditional uses such as horse stable and equestrian activities. 6. Park and recreational uses that are passive in nature such as picnicking, arts and crafts workshops, cultural performances, etc. Conditional Uses Permitted The following conditional uses will be permitted within a portion of the Low Density Commercial District with frontage on Los Rios Street and Del Obispo Street: -1- 150 1. The retail sale of apparel, fabrics, dry goods, ornamental plants, flowers, candy, baked goods, hobby supplies, arts and craft supplies, photography supplies, stationery, newspapers and magazines, and similar items which require small- scale retail outlets. (The cumulative total of these uses shall not exceed 1000 square feet.) 2. Small-scale service uses, including barber shops, beauty shops, tailor shops, photography studios, watch repair shops, ticket agencies, and locksmith shops. 3. Small-scale specialty food and lodging uses (except drive-in or drive-thru facilities), ice cream parlors, delicatessens, etc. where it can be demonstrated that the proposed use will not generate large volumes of vehicular traffic which would create traffic safety problems. 4. Public and semi-public buildings, services, and facilities, including museums, libraries, government buildings, parks, public utility offices and exchanges, information centers and churches. 5. Business, vocational, and professional schools not requiring outdoor facilities, including secretarial, art, dance, drama, music, barber, and beauty, but excluding swimming schools, preschools, and public or private primary or secondary schools. 6. All permanent access to the property will be either from Los Rios Street or new park road as depicted on the Circulation Plan of the Los Rios Precise Plan. The possibility of temporary vehicular access to Del Obispo Street with right turns only shall be considered as part of the Master Plan. b. Parking requirements shall be per Ordinance No. 293 (Land Use Management Code). Other Development Standards: a. The development of the subject property shall be master planned as a whole even though construction may be phased. b. Any structure shall be subject to the Development Review Procedures of Part IV of the Los Rios Precise Plan. Principal uses permitted under Items Nos. 3 through 6 shall conform with provisions of Ordinance No. 293 (Land Use Management Code), Section 3.4.21 Open Space Preservation with the following modifications, delete B.2, B.7, D.1, D.3. (Areas 1 and 2). Development subject to site design standards of the Los Rios Precise Plan and to the development review process identified in Part 4. New development will conform to site design standards (Section 3.4.4) and will provide appropriate landscaping.
