RESOLUTION NO. 77-10-5-1
GENERAL PLAN AMENDMENT 77-2 (SWEENEY
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING
GENERAL PLAN AMENDMENT 77-2, ITEM B (SWEENEY)
WHEREAS, the applicant, David Sweeney, has petitioned
the City Council for a change in land use designation for a 20+
acre parcel from 1.4 Medium Density Residential to 4.1
Quasi -Industrial; and,
WHEREAS, The City's Environmental Review Board has
determined that the project may have a significant impact on
the environment and has caused an Environmental Impact Report
to be prepared, and has otherwise carried out all applicable
provisions of the California Environmental Quality Act of 1970;
and,
WHEREAS, the Planning Commission and City Council
have held duly -advertised public hearings, received public
testimony, reviewed the staff report, Environmental Impact
Report and other relevant material concerning the petition, and
considered all of the above in light of the goals and policies
of the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby approve General Plan Amendment 77-2, Item B, a
petition to change the land use designation for 20+ acres from
1.4 Medium Density Residential to 4.1 Quasi -Industrial based
upon the following findings:
' 1. The amended designation would create a
quasi -industrial use which exhibits the same
environmental characteristics as that associated
with the similar designation across the freeway.
2. The characteristics of quasi -industrial uses
often result in conflicts with nearby residential
uses. However, due to topographical considerations,
such conflicts are mitigated.
3. The change in land use designation from medium
density residential to quasi -industrial can be
considered a noise mitigation measure since it
will permit a more compatible land use within a
high noise environment. If a residential use was
permitted, extensive noise buffering would have
to be designed and constructed to reduce the
exterior noise level emanating from the San Diego
Freeway corridor. This would require a substantial
physical barrier such as a block wall. Due to
the close proximity of the site to the freeway
travel lanes, and further due to the lack of any
real grade difference between the freeway and the
western portion of the property, a fairly extensive
' block wall would be needed, exceeding ten feet in
height. A wall of this size would present a
visual obstruction as seen from the freeway.
4. The proposed land use may result in a reduction
in landform alteration due to the project sponsor's
intent to provide a landscape buffer on the
easterly slope. If residential development took

place, extensive grading of the entire site
(including the steep hillside on the eastern half
of the property) would be needed to develop at
the General Plan density.
