RESOLUTION NO. 79-4-4-9
SETTING FORTH LOCAL CONDITIONS JUSTIFYING
AMENDMENTS TO NATIONAL ELECTRICAL CODE, 1978 EDITION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, SETTING
FORTH LOCAL CONDITIONS JUSTIFYING AMENDMENTS
' TO THE NATIONAL ELECTRICAL CODE, 1978 EDITION
WHEREAS, Health and Safety Code Section 17958.5 provides
that a City governing body may make such changes or modifications
to the National Electrical Code, 1978 Edition, as are reasonably
necessary because of local conditions; and,
WHEREAS, Health and Safety Code Section 17958.7 requires
the City governing body (City Council) to make express findings
of the necessity for modifications in the National Electrical
Code; and,
WHEREAS, the Supervisor of the Division of Building and
Safety of the City of San Juan Capistrano has recommended that
the National Electrical Code, 1978 Edition, be adopted by the
City with certain modifications and amendments which are required
by local conditions.
NOW, THEREFORE, BE IT RESOLVED, that the modifications
to the National Electrical Code, 1978 Edition, recommended by the
Supervisor of Building and Safety are hereby expressly found to
be necessary on account of local conditions as follows:

1. Section 2 (1) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment adds a third paragraph to Section
90-4 of the National Electrical Code to vest the
authority for enforcement of the provisions of the
Code. This amendment is necessary to provide a
means for providing local control and enforcement
of Code requirements.
2. Section 2 (2) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment adds a new Section 90-8 to the
National Electrical Code setting forth the
responsibilities of all parties concerned with any
electrical work within the City of San Juan
Capistrano. This amendment is necessary to
provide local control and Code compliance
verification of the safety of electrical work
performed within the City.
3. Section 2 (3) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment adds a new Article 91 to the

National Electrical Code, setting forth the
conditions under which electrical work will be
permitted, the permits to be issued and methods of
application therefore, permit validity requirements,
inspections to be performed, and setting the fees
therefor. This amendment is necessary to cover
an area of omission in the National Electrical
Code and to provide for local control and
verification of public safety of electrical work
performed within the City.

4. Section 2 (4) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment adds a new Article 92 to the
National Electrical Code, setting forth standards
for electrical equipment, labeling, listing,
prohibition of used materials and establishing
occupancy classifications in accordance with the
Uniform Building Code, 1976 Edition. This
amendment is necessary to provide for local control
of the safety of life and property.
5. Section 2 (5) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment adds a new Article 93 to the National
Electrical Code, covering alterations, additions,
relocations, and changes in occupancy of buildings,
and making the provisions of the National Electrical
Code applicable to these types of construction,
and setting forth electrical requirements for
Historical Buildings. This amendment is necessary
to provide for local control of the safety of life
and property.
6. Section 2 (6) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 110-5 of the National
Electrical Code states a preference for copper
conductors, and requires that aluminum conductors,
where expressly allowed by the National Electrical
Code, be not smaller than #6 AWG in size. This
amendment is necessary due to product studies for
the locality which show that such minimum size is
reasonably necessary because of local climatic and
environmental conditions to avoid hazard or
danger to the safety of persons or property.
7. Section 2 (7) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 210-1 of the National
Electrical Code requires undergrounding of
electrical conductors to accessory buildings and
other specified uses and locations. It also
provides that space and/or raceways shall be
provided in certain specified instances for spare
and future circuit installations. This amendment
is necessary because of local soil, wind and other
climatic conditions.
8. Section 2 (8) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 210-25(b) of the National
Electrical Code requires that at least one receptacle
outlet be installed in each basement and attached
or detached garage or carport. This amendment is
necessary because of local prevalence of these
structures and local consumer patterns for high
use of residential tools and appliances.
9. Section 2 (9) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 210-25 of the National
Electrical Code adds a new subsection (e) which

provides that no conductor smaller than No. 12
AWG may be used in a receptacle circuit and
provides for separation of lighting and receptacle
circuits. This amendment is necessary because of
local residential density and local consumer
patterns for the high use of residential electrical
applicances.
10. Section 2 (10) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment rewrites Section 210-26 of the
National Electrical Code to more fully specify the
location, construction, switching and accessibility
of lighting outlets. This amendment is necessary
due to local residential housing patterns, local
residential density, and style of local housing
being constructed.
11. Section 2 (11) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment revises Section 215-26 of the
National Electrical Code to provide for increased
feeder conductor ampacity to serve larger
service entrance conductors. This amendment is
necessary due to local residential construction
patterns which require greatly increased electrical
energy availability to adequately supply the
connected loads.
12. Section 2 (12) of Ordinance No. 372 of the City of
San Juan Capistrano.
' This amendment to Article 215 of the National
Electrical Code adds a new subsection, 215-10,
requiring all feeder conductors in commercial and
industrial structures be installed in an approved
raceway. This amendment is necessary due to local
wind, atmospheric and other climatic conditions.
13. Section 2 (13) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 250-115 of the National
Electrical Code provides that the connection point
of the grounding conductor and a grounding fitting
or device be readily accessible, and is required
by local conditions affecting public safety to
life and property.
14. Section 2 (14) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment to Section 336-3 of the National
Electrical Code restricts the use of non-metallic
sheathed cables to certain residential applications.
Use of these cables for commercial and industrial
applications is not permitted, and is necessitated
by local climatic and other conditions.
15. Section 2 (15) of Ordinance No. 372 of the City of
San Juan Capistrano.
This amendment, deleting Section 336-11 of the
National Electrical Code, eliminates the use of
exposed cable wiring without boxes, and is necessary
because of local climatic, environmental and safety
conditions.

16. Section 2 (16) of Ordinance No. 372 0£ the City of
San Juan Capistrano.
This amendment to Section 600-2 (a) of the National
Electrical Code requires that a disconnecting
device shall be located on or in electrical signs,
not merely within sight of the sign, and is
required due to local conditions affecting the
safety of life and property.
BE IT FURTHER RESOLVED that the City Clerk shall be and
hereby is authorized and directed to forward, for filing, a copy of
this Resolution, together with the Ordinance adopting the National
Electrical Code, 1978 Edition, as amended, to the State Department
of Housing and Community Development. -
