Resolution Number 79-2-21-5171 RESOLUTION NO. 79-2-21-5 TENTATIVE PARCEL MAP 852 (SWEENEY/KING) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP 852, A SUBDIVISION OF 23.2+ ACRES INTO THREE (3) PARCELS LOCATED ADJACENT TO THE EAST SIDE OF INTERSTATE 5 BETWEEN SAN JUAN CREEK AND ORTEGA HIGHWAY WHEREAS, the applicant, Landmark Investments, 150 South Robles Avenue, Pasadena, California, has submitted an application to subdivide 23.2+ acres into three (3) parcels with a minimum lot size of 6.03+ acres located on Assessor's Parcel No. 666-131-05; and, WHEREAS, the Environmental Review Board has reviewed the project and determined that it may have a significant impact on the environment and has further determined that the Environmental Impact Report prepared for Rezone 78-1 adequately addressed the impacts of the project, and has otherwise carried out all applicable requirements of the California Environmental Quality Act; and, WHEREAS, the Planning Commission upon conducting a duly noticed public hearing and review of public testimony on the application, has forwarded a recommendation of approval, subject to conditions, to the City Council; and, WHEREAS, the City Council has conducted a duly noticed public hearing to receive and review testimony on the application. NOW, THEREFORE, BE IT RESOLVED that based upon the following findings: 1. The tentative parcel map is consistent with the 4.0 Industrial Park and PC (Planned Community) designation of the Composite Land Use Map and other applicable goals, policies, and objectives of the General Plan. 2. The project design is generally consistent with the development constraints of the approved PC (Planned Community) District regulations and the specific area plan being prepared for the area. 3. That the project site is physically suitable for the type of development and density of future proposed uses. 4. That the project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 5. That the design of the subdivision will not cause serious public health problems. 6. That the design of the subdivision or future improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. The City Council does hereby approve Tentative Parcel Map 852, subject to the following conditions: -1- 1'72 1. The applicant shall enter into an agreement which waives opposition to formation of Assessment District 78-3. 2. All development plans shall be designed in accordance with the approved area plan for Planning Sector B of Comprehensive Development Plan 78-1 (Ortega Planned Communities). 3. Approval of Tentative Parcel Map 852 shall not be construed as approval of any specific land use for the subject parcei. 4. Further subdivision of the subject parcel shall not be approved until the area plan for Planning Sector B, Comprehensive Development Plan 78-1 is approved.
