A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING CONDITIONAL USE PERMIT 78-7, A PROPOSED
PRIVATE EQUESTRIAN CENTER FOR THE MISSION HILLS
HOMEOWNER'S ASSOCIATION
WHEREAS, the applicant, Mission Hills Homeowner's
Association, c/o Jill Hanna, 30161 Branding Iron Road, San Juan
Capistrano, California, has submitted an application for a proposed
private equestrian center located at the southeast terminus of
Mission Hills Drive; and,
WHEREAS, the Environmental Review Board has reviewed
the project and has determined that it would not have a significant
impact on the environment, has granted a Negative Declaration,
and has otherwise carried out all applicable provisions of the
California Environmental Quality Act; and,
WHEREAS, the Planning Commission has reviewed the
application and recommends approval subject to conditions; and,
WHEREAS, a public hearing has been duly noticed and
held to review and receive public testimony on the application.
NOW, THEREFORE, BE IT RESOLVED, that based upon the
following findings:
1. The application is generally consistent with the
goals, policies and objectives of the General
Plan.
2. The proposed use will be developed in conformance
with the provisions of Ordinance No. 293.
3. The application will be compatible with existing
and proposed uses within the immediate vicinity.
4. All dedications, improvements, and fee requirements
will be met in accordance with City ordinances.
The City Council does hereby approve Conditional Use
Permit 78-7, subject to the following conditions:
1. The site plan and structural plans submitted in
accordance with this application shall be considered
precise. Any change, modification, or addition,
shall require review and approval by the Planning
Commission as an amendment to this permit.
2. Prior to issuance of any permits, the applicant
shall process a lot line adjustment for Lot No.
31, Tract 6381.
3. Precise grading and landscape plans shall be
reviewed and approved by the Planning Commission
prior to issuance of any permits.
4. Security lighting plans for the paddock area shall
be submitted and approved by the Director of
Community Planning and Development. Lighting of
the arena area shall be prohibited.

5. The maximum number of horses which may be maintained
in the facility shall not exceed 27, except horses
less than six (6) months of age shall not be
counted per Section 3.6.20, Ordinance No. 293.
All horses kept at the subject facility shall be
owned by residents of Mission Hills Homeowner's
Association.
PASSED, APPROVED AND ADOPTED this 7th day of
