Resolution Number 80-3-5-1 331 RESOLUTION NO. 80-3-5-1 RESIDENTIAL CONCEPT PLANS - CADILLAC-FAIRVIEW GROWTH MANAGEMENT 79-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING RESIDENTIAL CONCEPT PLANS FOR A 71 UNIT DEVELOPMENT ON 12. 75+ ACRES SOUTH OF CAMINO DEL AVION AND ALIPAZ WHEREAS, the applicant, Cadillac-Fairview Homes West, has submitted Residential Concept Plans for a Planned Residential development project on a 12 .75+ acre parcel in accordance with Ordinance No. 314 (Residential Growth Management) ; and, WHEREAS, the City Council has determined that the Environmental Impact Report prepared for the project addressed the environmental impacts of the proposed Residential Concept Plans; and, WHEREAS, the Planning Commission has reviewed the concept plans and forwarded said plans recommending approval subject to conditions; and, WHEREAS, the City Council, after holding a duly-noticed public hearing, hereby finds and determines as follows: 1. The growth management rating of 57 points is accurate and appropriate. 2. The proposed concept plans are consistent with the General Plan land use designations and is otherwise consistent with all other elements of the General Plan. 3. The proposed concept plans are consistent with the PRD zoning on the property and the requirement of Ordinance No. 293 . BE IT FURTHER RESOLVED, that the City Council does hereby approve Residential Concept Plan GM 79-4 subject to the following conditions : 1. Pursuant to Section 5 of Ordinance No. 314 , Residential Concept Plan approval does not constitute final approval of a project. All further requirements of Ordinance No. 314 and Ordinance No. 293 must be satisfied for the subject development parcel. 2. If the subject parcel is granted building permit allocations under Ordinance No. 314 , the processing of composite development plans will be required to be submitted and approved concurrent with tentative map review and approval. Said plans shall consist of: a. grading plans; b. building elevations; C. landscape plan; and d. final site plan. 3. Proof of geological and soils stability of all proposed grading and development within the subject parcels shall be submitted to the satisfaction of the City prior to any tentative tract map approval. -1- 332 4. Approval of these Residential Concept Plans shall be rendered null and void if the PRD zone change ordinance for property is not approved by the City Council. 5. The General Plan Bike Trail shall be located along the eastern property boundary. 6. An agreement between the property owner and the Orange County Flood Control District shall be executed prior to the acceptance of the final tract map. Said agreement shall regard the planting of landscaping in the flood control — easement along San Juan Creek. 7. Roof pitches for units along the open space areas shall be designed in a manner to avoid a canyon effect. The property owner shall submit a visual analysis of these spaces to the Planning Commission during composite development plan review. 8 . Roadways shall be a minimum of 28 feet curb-to-curb within the development. 9. Two units shall be eliminated adjacent to the Troy/Marina homes development. The units are located on Exhibit A attached hereto. The resulting unit count shall then be 71 dwelling units.
