RESOLUTION NO. 80-2-6-3
TENTATIVE TRACT 10564 (CAPISTRANO INDUSTRIAL PARK)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING TENTATIVE TRACT 10564 (CAPISTRANO
INDUSTRIAL PARK)
WHEREAS, the applicants, Julian Willcox and Bruce
Winton, 32932 Calle Perfecto, San Juan Capistrano, California,
have submitted Tentative Tract 10564, a proposal to subdivide 19.5
acres into 17 industrial lots located on the eastern side of San
Juan Creek on the area once used for general aviation; and,
WHEREAS, the City's Environmental Review Board has
reviewed the project and determined that it may not have a
significant impact on the environment, and has issued a Negative
Declaration, and has further carried out all applicable provisions
of the California Environmental Quality Act; and,
WHEREAS, the City's Planning Commission, after holding
a public hearing on the subject tentative tract, has forwarded a
recommendation to conditionally approve said map; and,
WHEREAS, the City Council of the City of San Juan
Capistrano, finds and determines as follows:
1. That the project as submitted is consistent with
all applicable goals, policies and objectives of
the General Plan.
2. That the design or improvements of the proposed
subdivision is consistent with the applicable
general and specific plans.
3. That the site is physically suitable for the type
of development.
4. That the site is physically suitable for the
proposed density of development.
5. That the design of the subdivision or the proposed
improvements will not cause substantial environmental
damage or substantially and avoidably injure fish
or wildlife or their habitat.
6. That the design of the subdivision or the type of
improvements will not cause serious public health
problems.
7. That the design of the subdivision or the type of
improvements will not conflict with easements,
acquired by the public at large, for access
through or use of, property within the proposed
subdivision.
8. That the design or improvements of the proposed
subdivision will not interfere with the maintenance
or preservation of an historical site.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve Tentative
Tract 10564, subject to the following conditions:
1. Finish pad elevations for individual lots shall be
no higher than that required for minimal satisfaction
of the FP -2 District development standards.

1 2. Composite Development Plans shall be reviewed and
approved by the Planning Commission prior to
approval of a final map. Said composite shall
include the following components:
a. typical building elevations
b. conceptual landscape plans
C. site plan
d. conceptual grading plan.
3. Calle Aviador shall be dedicated and improved with
a standard right-of-way width of 53 feet as proposed _
on the submitted tentative map. Said improvements
shall include a full street section, curbs, gutters,
sidewalks, landscaping, and other improvements as
required by Ordinance No. 293.
4. Access rights for Calle Aviador shall be dedicated
to the City for all right-of-way adjacent to the
north property line of Lot No. 9, Tract 6402.
5. An irrevocable offer of dedication over Lot No. 16
shall be made to the City of San Juan Capistrano
for the future extension of Calle Aviador. Said
offer shall be a minimum 46 feet in width.
6. All applicable fees shall be paid prior to final
map approval.
7. Conditions, Covenants and Restriction shall be
submitted which provide for continued landscape
maintenance of all landscaping within the public
right-of-way and required 10 -foot landscape buffer
area for Tentative Tract 10564. Said CC&R's shall
require each individual parcel owner to maintain
the landscaping on the subject lot and adjacent
public right-of-way. Said CC&R's shall be approved
as to form and content by the Director of Public
Works and City Attorney, and reviewed and approved
by the City Council prior to recordation of a
final tract map.
8. Water improvement plans shall be reviewed and
approved by the Orange County Fire Marshall and
Orange County Waterworks District No. 4.
9. In order to provide effective visual buffering
between the project and areas across the San Juan
Creek recreation corridor a 10 -foot landscape
buffer strip shall be provided along the rear
property line with San Juan Creek. The rear yard
setback for buildings located adjacent to San Juan
Creek shall be a minimum 75 feet. The 10 -foot
wide buffer strip is included within the 75 -foot
rear setback. The area within the 75 -foot rear
setback may be developed with parking and additional
landscaping. The conceptual site plans and building
foot prints shall be adjusted to provide for these
development constraints. The amended site plan
shall be approved by the Planning Commission prior
to approval of a final map. Final landscape plans
for the buffer strip shall be approved by the
Architectural Board of Review. Landscape
installation for the entire length of the 10 -foot
buffer strip shall be commenced immediately upon
completion of rough grading and pursued diligently
until completion.
10. The draft development guidelines submitted by the
applicant as amended per comments 8 (a) through
(d) of the Council staff report dated February 6,
1980, shall supplement the City's Land Use Code
and other regulations during Architectural Board
of Review and Planning Commission review of individual
lot development.

11. Approval of this tentative map shall in no way be
construed as approval of the preliminary site plan
and architectural concepts submitted by the
applicant. Further, said concepts shall not be
considered as pre -determining the design or site
planning for the development of individual lots.
Except for the side yard setback variance approved
as Zone Variance 79-26, all development shall
' conform to the design constraints of Ordinance
No. 293 and conditions of this map.
12. Conceptual site plans, landscape plans, and
architectural schematics for individual buildings
within the project shall be approved by the
Architectural Board of Review and the Planning
Commission. Subsequent working drawings for such
individual buildings shall then be approved by the
Architectural Board of Review.
13. The variance for reduction in side yards approved
by the Planning Commission (Zone Variance 79-26)
shall apply only under the following conditions:
a. The reduction is to 0 feet (zero lot -line)
b. The building on the adjacent lot on that side
is also zero lot -line (common wall)
C. The setback from the opposite side property
line is a minimum of 20 feet.
