Resolution Number 79-12-19-3139 RESOLUTION NO. 79-12-19-3 THE RANCH RESIDENTIAL CONCEPT PLANS: PARCELS 1-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING RESIDENTIAL CONCEPT PLANS FOR PARCELS 1 THROUGH 4 OF THE RANCH PLANNED COMMUNITY WHEREAS, the applicant, The Ranch of San Juan Capistrano, has submitted Residential Concept Plans for Parcels 1 through 3 (Growth Management 79-2) and Parcel 4 (Growth Management 79-3) within The Ranch Planned Community in accordance with Ordinance No. 314 (Residential Growth Management); and, WHEREAS, the proposed development parcels include the following unit counts: Parcel 1: 9 Parcel 2: 6 Parcel 3: 6 Total: 21 Parcel 4: 29; and, WHEREAS, the City's Environmental Review Board has determined that the environmental impact report prepared for the project's General Plan Amendment addresses the environmental impacts of the proposed Residential Concept Plans subject to completion of the visual impact analysis for Helicopter Hill; and, WHEREAS, the Planning Commission has reviewed the concept plans, has recommended adoption of draft growth management point ratings for the concept plans, and has forwarded said plans to the City Council recommending approval subject to conditions; and, WHEREAS, the City Council, after holding a duly -noticed public hearing, hereby finds and determines as follows: 1. The growth management point ratings of 66 points for Parcels 1 through 3 and 64 points for Parcel 4 are accurate and appropriate. 2. The proposed concept plans, as conditioned, are consistent with General Plan land use designations and are otherwise consistent with all other Elements of the General Plan. 3. The proposed concept plans, as conditioned, are consistent with the PC Planned Community zoning on the property, the PC Comprehensive Development Plan and the requirements of Ordinance No. 293 (Land Use Management Code). NOW, THEREFORE, BE IT RESOLVED, that the following growth management point ratings are hereby adopted for the subject residential concept plans per Ordinance No. 314: 1. Parcels 1 through 3: 2. Parcel 4: 66 points. 64 points said point ratings being detailed on attached Exhibits I and II. BE IT FURTHER RESOLVED, that the City Council does hereby approve Residential Concept Plans GM 79-2 and GM 79-3 subject to the following conditions: -1- 1. Pursuant to Section 5 of Ordinance No. 314, Residential Concept Plan approval does not constitute final approval of a project. All further requirements of Ordinance No. 314, Ordinance No. 293, and the PC Comprehensive Development Plan must be satisfied for all of the subject development parcels. 2. If the subject parcels are granted building permit allocations under Ordinance No. 314, the processing of composite development plans and subdivision maps will be required in accordance with Section 3.2.1 of the PC Comprehensive Development Plan. 3. Proof of geological and soils stability of all proposed grading and development within the subject parcels shall be submitted to the satisfaction of the City prior to any tentative tract map approval. 4. Architectural schematics submitted with the Parcel 4 concept plan shall not be considered part of this approval. Such plans shall be reviewed during consideration of composite development plans for the parcel per Section 3.2.1 of the Comprehensive Development Plan. 5. Approval of these Residential Concept Plans shall be rendered null and void if the PC zone change ordinance for The Ranch property is not approved by the City Council prior to Council consideration of the next growth management Residential Allocation Schedule. 6. In accordance with the provisions of Section 3.4.10 of Ordinance No. 293, the PC Comprehensive Development Plan text is hereby amended as follows: A. Parcel Unit Counts: Sections 2.4.2 and 3.3.2 and Figures 2.3.2 and 2.4.1A are amended to show the following maximum unit counts: Parcel Maximum No. of Units 01, B. Height of Accessory Structures: Subsections 3.3.7J and 3.3.8J are added to read as follows: "J. Height of Accessory Structures: The City may approve the construction of accessory structures up to 10 feet higher than their associated residential structures (measured from each structure's average finish grade) if the City finds that such higher accessory structure will not have an adverse impact on other nearby residences or result in an adverse impact on views from outside the development parcel in question." -2- 141 7. In accordance with prior City Council action and Section 2.2.2 of the Comprehensive Development Plan, no dwelling units may extend above the "Helicopter Hill" (Parcel 4) ridgeline silhouette as viewed from the valley floor. Therefore, no tentative tract map shall be approved for Parcel 4, which includes dwelling units extending above said ridgeline silhouette.
