Resolution Number 79-11-28-2113 RESOLUTION NO 79-11-28-2 AMENDED APPLICATION FOR ANNEXATION (VAN ROEKEL, ET AL.) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING RESOLUTION NO. 78-9-6-5 BY EXPANDING THE PROPOSED ANNEXATION AREA IN ITS APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION FOR THE ANNEXATION OF TERRITORY ADJACENT TO THE NORTH BOUNDARY OF THE CITY (ANNEXATION AREA IDENTIFIED AS VAN ROEKEL, ET AL.) WHEREAS, the City Council adopted Resolution No. 78-9-6-5 on September 6, 1978, making application to the Local Agency Formation Commission for annexation of four parcels to the City; and, WHEREAS, the City Council deems that two additional parcels and right-of-way for Marguerite Parkway, Via Escolar, and Interstate 5 (all within the City's approved sphere of influence) should also be included in the application for annexation; and, WHEREAS, the resulting proposed annexation area, as amended, is identified as: Assessor Parcels: Marguerite Parkway Via Escolar Interstate 5 650-011-05 650-011-18 650-011-24 650-011-25 650-011-26 650-011-28 Right -of -Way Right -of -Way Right -of -Way as identified on Exhibit A, attached hereto; and, WHEREAS, the City's Environmental Review Board has determined that the subject annexation will not have a significant impact on the environment, and has, accordingly, issued a negative declaration for the annexation project, and has otherwise carried out all requirements of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED, that the City of San Juan Capistrano does hereby make application to the Local Agency Formation Commission to annex the property herein described to the City and requests that appropriate proceedings be taken pursuant to the Municipal Organization Act of 1977.
