RESOLUTION NO. 79-10-17-3
TENTATIVE PARCEL MAP 851 (COLLINS DIVERSIFIED
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING TENTATIVE PARCEL MAP 851, THE DIVISION
OF 5.97 ACRES INTO FOUR PARCELS
WHEREAS, the applicant, Philip Whitener, c/o Collins
Diversified, 270 South Bristol, Suite 201, Costa Mesa, California,
has submitted an application for subdivision of 5.97 acres into
four parcels, located on the west side of Camino Capistrano
immediately north of San Juan Creek; and,
WHEREAS, the City's Environmental Review Board has
reviewed the project and has determined that the overall project
submittal may have a significant impact on the environment and
has caused a focus Environmental Impact Report to be prepared,
and has otherwise carried out all applicable requirements of the
California Environmental Quality Act; and,
WHEREAS, the Planning Commission reviewed the
applications at the regular meeting of April 10, 1979, and has
submitted a report recommending approval subject to conditions;
and,
WHEREAS, the City Council had previously reviewed the
project and denied the application without prejudice; and,
WHEREAS, the applicant has requested reconsideration of
the application; and,
WHEREAS, a public hearing has been duly advertised and
held to review and receive public testimony on the application.
NOW, THEREFORE, BE IT RESOLVED, that based upon the
following findings relative to Tentative Parcel Map 851:
1. That the site is physically suitable for the type
of development proposed under Architectural
Control 79-7.
2. That the design of the subdivision and proposed
improvements will not cause substantial environmental
damage.
3. That the design of the subdivision will not cause
an adverse impact upon the public health, safety,
and welfare.
4. That the map design is consistent with applicable
General Plan policies and objectives.
5. That the map as conditioned, conforms to all
requirements of Ordinance No. 293 and is consistent
with the CG (General Commercial District).
The City Council of the City of San Juan Capistrano
does hereby approve Tentative Parcel Map 851 subject to the
following conditions:
1. CC&R's shall be required which establish a legal
mechanism for the landscape maintenance and joint
parking arrangement for the project as a whole.
Said CC&R's shall be approved by the City Attorney
and Director of Community Planning and Development
prior to approval of a final map.

2. Tentative Parcel Map 851 shall become null and
void if Zone Variance 79-7 is denied.
3. The developer shall construct a raised landscape
median on Camino Capistrano along the length of
the project frontage except at the intersection
with Avenida Padre.
4. The developer shall construct and dedicate right
turn lanes at access points on Camino Capistrano
as per the precise site plan approved as part of
A.C. 79-7.
5. The developer shall participate in costs for a
traffic signal at Camino Capistrano and San Juan
Creek Road. Participation costs shall be based
upon the increase in intersection traffic at
Camino Capistrano and San Juan Creek Road generated
by the project developed per A.C. 79-7.
6. All on-site overhead utilities shall be converted
to underground.
7. Locate and construct driveways according to Section
4.1.4 of the Land Use Management Code.
8. vehicular access rights shall be released and
relinquished to the City except at street
intersections and driveways as shown on A.C. 79-7.
9. Utility undergrounding shall be done in accordance
with Section 4.1.7 of the Land Use Management Code
in addition to the City's underground policy.
10. Water transmission and distribution facilities
shall be designed, constructed and dedicated
according to Section 4.1.9 of the Land Use
Management Code.
11. Sanitary sewers shall be designed, constructed and
dedicated according to Section 4.1.11 of the Land
Use Management Code.
12. All fees shall be paid prior to approval of the
Final Map.
13. The property owner shall enter into an agreement
with the City that if building permits are not
issued within 12 months of this approval for the
future development of the property pursuant to
A.C. 79-7, the property owner shall process a _
reversion to acreage for Tentative Parcel Map 851
into its original configuration.

October 1 1979 , by the following vote, to wit:

Buchheim and Mayor Friess
