A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, AMENDING RESOLUTION NO. 99-11-16-3
FORMING UNDERGROUND UTILITY DISTRICT 99-01 TO ALLOW RULE
20A FUNDS TO PAY FOR THE CONVERSION OF PRIVATE UTILITY
SERVICES
'WHEREAS, on November 16, 1999, the City Council of the City of San Juan Capistrano
adopted Resolution No. 99-11-16-3 confirming the formation of Underground Utility District
No. 99-01; and,
WHEREAS, the California Public Utilities Commission has since changed its Rule 20A
funds to reimburse municipalities for the cost of converting residential and commercial
utility services within an Underground Utility District; and,
WHEREAS, the City Council has determined that using Rule 20A funds to pay for the
cost of such work will significantly reduce the time involved in constructing the
improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan
Capistrano as follows:
1. That the above recitations are true.
That Resolution No. 99-11-16-3 is hereby amended to include the following
paragraphs:
That Rule 20A funds shall be used to fully reimburse the City of San Juan
Capistrano labor, material, tools, equipment, and incidentals needed to provide
underground utility service to all private residences and businesses within the
subject district limits that are to remain intact. No expense shall be incurred by
any affected property owner, unless the property owner requests an increase in
electric meter panel size. In such a case, the property owner shall pay the full
cost required to upgrade the meter panel. No -fee permits for the subject
construction shall be issued to the selected contractor by the City of San Juan
Capistrano.
The reimbursable work shall include, but not be limited to, trenching for and
installing conduit and pull rope from the property line to the point of utility service
(100' maximum), converting private utility service from overhead to underground,
and providing and installing pull boxes, electric meter panel adapters, and
' related appurtenances for SDG&E. SDG&E shall specify the size and type of
trench, conduit, pull rope, and related appurtenances for its own facilities. The
conduit, pull rope, and related appurtenances for communications and/or cable

television service shall be provided and installed by the corresponding utility
company at its own expense.
The reimbursable work shall be publicly advertised for competitive bids and
awarded to the lowest responsive and responsible bidder. SDG&E shall provide
a list of all electric meter panel conversions and a cost estimate for each. The
City shall reject any bid for any meter panel conversion that is determined to be
excessive in cost. The maximum cost for any meter panel conversion shall be
$3,000.00. All meter panel conversions shall be paid for by the City and the City
shall be fully reimbursed by SDG&E with allocated Rule 20A funds.
