AMENDMENT TO COMPREHENSIVE DEVELOPMENT PLAN 75-1,
ORDINANCE NO. 297 (PUEBLO SERRA PLANNED COMMUNITY;
A RESOLUTION OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING ORDINANCE NO. 297 BY CHANGING
CONSTRUCTION PHASING AND DELETION OF THE SHUTTLE
BUS REQUIREMENTS FOR THE AREA REFERRED TO AS THE
PUEBLO SERRA PLANNED COMMUNITY
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has reviewed
the subject amendments, has determined that the
project will have a significant effect on the
environment, has required the preparation of an
Environmental Impact Report, and has otherwise
carried out all requirements of the California
Environmental Quality Act. (The environmental
impact report prepared for the project has been
certified as adequate.)
2. The proposed amendments are consistent with the
land use, circulation and other designations shown
for the property in the General Plan. The proposed
amendments are otherwise consistent with the goals
and policies of the General Plan for the Pueblo
Serra Planned Community.
3. The development of the property will conform to
the development standards and other applicable
provisions of Ordinance No. 297.
4. Municipal Code Title 9, Chapter 3, Article 4,
Section 9-3 410.C.3(i) provides for the amending
of the Comprehensive Development Plan by Resolution
provided it is consistent with the overall purpose
and general design of the adopted Planned Community
Regulations.
SECTION 2. Amendment to Ordinance No. 297.
Based on the findings set forth in Section 1, preceding,
the City Council ordains that: (1) Section 14 C, pages 23-25
(Comprehensive Development Plan 75-1) is amended per Exhibit "A"
attached (Phasing); and (2) Section 10 D is hereby deleted (Shuttle
Bus) from Ordinance No. 297 heretofore previously adopted
December 3, 1975.
SECTION 3. Effective Date.
This Resolution shall take effect and be in force 30
days after its passage.
SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Resolution and cause the same to be posted in the duly -designated
posting places within the City of San Juan Capistrano within 15
days after its passage.

Architectural Restrictions
Purpose and Intent:
To provide concepts, standards, and criteria to act as guide-
lines in order to insure that all phases of development are
integrated into a cohesive center with design consistency that
meets all of the goals of the City's General Plan.
Phasing:
The three major phases may be separated into six distinctive
projects, each of which may have its own separate owner -devel-
oper -architect team.

6. Offices & Other Commercial
Overall Design Control Philosophy:
It is not the intent of these restrictions, to be tight rigid
controls. Freedom of design is important, as long as there is
consistency of certain key elements throughout the project.

It is the intent of these restrictions to establish firm guide-
lines for these nine architectural elements, and to allow the
1st phase - CO-CG/Other Commercial to refine the concepts and
act as the final guide for future phases.
Site Design Concepts -
A. The following items must be adhered to:
1. Circulation systems for automobiles and bicycles
as per Concept Plan,
2. Bus stops as per Concept Plan and Transportation
Management Program,
3. Parking lot pods - In order to avoid mass areas of
asphalt, all parking areas shall be broken up into
pods, as per Concept Plan,
4. Building location - In order to avoid the problems
of "strip commercial" development, buildings shall
be located in the approximate areas as per Concept
Plan. The Concept Plan is to be a guide for develop-
ment. The size, shape, and location of buildings
are schematic, and are not intended to depict the
final product.

5. All delivery and loading areas shall be screened from
view. Screening walls shall be part of the building
architecture, not added onto fences.
B. Forms and Scale of Buildings -
All buildings large or small, shall conform to the same
form and scale.
The building form shall be an important element of design.
It shall be simple and basic; it may be sculptural, but
not complicated. Barns, or the more simple missions such
as La Purisima Concepcion, San Jose -De. Guadalupe, or San
Miquel Arcangel, are good examples.
Scale shall relate to the pedestrian and rural atmosphere.
The overpowering bulk of larger buildings shall be dimin-
ished by having one story poritons or covered walkways.
along key portions of the building. Long rows of buildings
shall be discouraged, clustering around courtyards, or
plazas, shall be encouraged.
C. Architectural Theme -
The -buildings are not restricted to a "style" per se, but
are encouraged to reflect the feeling of the early agrarian
style farm and barn buildings.
The agricultrual heritage shall be accentuated with ap-
plicable elements and details. The atmosphere shall be
relaxed, comfortable and open.
Gimmickries, or cluttered design is not acceptable. Simple
forms, warm materials, sensitive scale, and attention to
detail shall be the guidelines.
D. Roof Design -
Roof design shall be simple and straightforward. Mansard
roofs are not allowed, flat roofs are discouraged, but al-
lowed to a limited degree. Consideration to the roof de-
sign as seen from the freeway and hills above, shall be
given high priority. Large overhangs are not necessary es-
pecially where they do not act as sun and rain protection.
E. Pedestrian Corridors -
Pedestrian scale and linkages are very important. Changes
of material and texture within parking pods, shall lead
pedestrians to entries.
Except at plazas, all store fronts shall contain a minimum
10' covered walkway. Trellis elements of similar scale and
design are encouraged.
F. Courtyard Concepts -
All groups of buildings shall cluster around a central plaza

H. Finish Materials -
In conjunction with the lst phase development, a
detailed list of materials, colors, and samples
shall be submitted to the Planning Commission for
approval. This shall establish the theme for the
following phases to conform to.
Freedom of design selection is encouraged, but the
use of wood and stucco is preferred. Mission dark
brown curved tile, heavy timber dark stained exposed
wood posts, beams, trellis members, are all encouraged.
Textured walks, tile, or stamped concrete, are mandatory.
Attention to finistration and detail is vital. It is
expected that the simple shapes and forms of the
buildings will be accentuated by interesting uses
of windows, doors, light fixtures, etc. Wood
balcony handrails shall be of a typical design through-
out.

14. Phasing
Phase I
A. Use
Phase I shall consist of those uses permitted under
CO -CG zoning.
B. Area
It shall not exceed 7.5 acres.
C. Timing
Phase I may consist of one or more sub -phases, and will
commence as soon as the necessary approvals are obtained.
Landscaping for the scenic drive and buffer areas may be
established at this time.
D. Capital Improvements Required
No major highway improvements are necessary. Junipero
Serra is to be improved to its ultimate section at the
restaurant site. Camino Capistrano may remain as ex-
isting, except that left turn pockets, acceleration
and de -acceleration lanes, and improved shoulders,
may be required for safe traffic movements.
1. Flood Control Facilities shall include:
a. A pipe near Oso Road from the railroad tracks
to Trabuco Creek.
b. A pipe from the freeway to the "hanging tree"
then an open•swale to Camino Capistrano within the
street right-of-way, then a pipe or conduit under
Camino Capistrano, and an open swale along the
orchard to Trabuco Creek.
2. Other requirements shall include:
a. A temporary equestrian linkage through the property
to Oso Road.
b.. A temporary bike route linking the 1st phase
development.
C. Alignment and an irrevocable offer of dedication
for the new Camino Capistrano.

Phase II
A. Use
Phase II shall consist of the entire CN area.
B. Area
It may include the entire area of this zone.
C. Timing
Phase II may consist of one or more sub -phases, and may
commence any time after Phase I is completed.
D. Capital Improvements Required
Any portion of this phase shall include
1. Camino Capistrano, full improvements of the re-
aligned street.
2. Connection of Oso Road to realigned Camino Capis-
trano.
3. Flood facilities
4. Irrevocable offer of dedication for Junipero
Serra.

A. Use
Phase III shall consist of the planned development resi-
dential area.
B. Area
It may include the entire area of this zone.
C. Timing
Phase III may consist of one or more sub -phases, and may
commence any time after the necessary noise buffers are
completed.
D. Capital improvements Required
They shall be the same as for Phase II

The 2.2 acres within Phase IV shall remain in an interim
use until:
1. The property to the north is planned, or
2. The depressed road and bridge over Trabuco
Creek is completed, and
3. The necessary amendment to this P.O. is ac-
complished.
