Resolution Number 80-10-15-2207 RESOLUTION NO. 80-10-15-2 ARCHITECTURAL CONTROL 80-3 (PUEBLO SERRA) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY APPROVING ARCHITECTURAL CONTROL 80-3 (PUEBLO SERRA) WHEREAS: 1. The applicant, First Commercial Enterprises, 2801 Barranca Road, Irvine, California, has submitted an application for approval of a commercial office complex located within the Pueblo Serra Planned Community. 2. The City's Environmental Review Board has determined that the proposed project will have a significant effect on the environment, has required the preparation of a supplemental report on traffic and archaeology for inclusion with the previously accepted EIR, has been certified as complete by the City Council, and has otherwise carried out all requirements of the California Environmental Quality Act; and, 3. The City Council hereby finds and determines as follows: a. The project is consistent with all applicable goals, objectives, and policies of the General Plan. b. The project, as designed and conditioned, is consistent with all applicable requirements of Title 9 (Land Use) of the Municipal Code and Ordinance No. 297 (Pueblo Serra Planned Community) . NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve Architectural Control 80-3, subject to the following conditions: 1. Per Section 9-2.305 of the Municipal Code, this project development approval shall expire on October 15, 1980, one year from the City Council approval date. If no building permit has been issued for the project by that date, the development approval shall become null and void. 2. Final building plans (working drawings) shall be reviewed by the Architectural Board of Review and shall be approved only if said Board determines that the working drawings are consistent with the concept plans approved with this Resolution. 3. Final landscape and irrigation plans shall be reviewed by the Director of Community Planning and Development and shall be approved only if the Director determines that said plans are consistent with the concept plans approved with this Resolution. 4. Wood trim colors shall be revised to pastel colors and submitted for review and approval during Phase III Final Working Drawings. -1- 208 5. The wall stucco shall utilize a smooth undulating finish similar to that used for Mercado Capistrano. 6. The buffer landscape species shall be a Eucalyptus Rudis. 7. The equipment wells shall be revised and approved during Phase III review incorporating the following design features: (a) opening shall be minimal and in scale with the overall roof; (b) the opening shall be substantially lower than the ridge;(c) the backdrop wall shall be inset to provide a shadow effect; (d) backdrop wall shall be in a color similar to the roof material; (e) open wood rafters stained to similar color of roof material; and (f) planting of vertical trees for screening. 8. The applicant shall dedicate and improve a half street section for that portion of Junipero Serra and realigned Camino Capistrano adjacent to parcels nos. 5 and 7 of Tract Map 10634 per Ordinance No. 297 and the Master Plan of Arterial Highways. 9. Water transmission and distribution facilities shall be designed, constructed, and dedicated in accordance with Section 9-4.109 of the Municipal Code and the requirements of Orange County Water Works District No. 4. Such distribution facilities and appurtenances shall be approved by the County Fire Marshal. 10. All manufactured slopes shall be designed and constructed in accordance with Section 9-3.505 and 9-4.112 of the Municipal Code. All such slopes shall be 2:1 ratio or flatter. 11. Driveways, pedestrian ways, bikeways, equestrian trails, utility undergrounding, street lights, traffic signals, drainage facilities, and sanitary sewers shall be located and constructed in accordance with Article 9-4.1 (Design,Standard;s - and Requirements) of the Municipal Code and adopted City policy. 12. A geotechnical feasibility study shall be completed to determine the seismic safety and soils stability of all proposed grading and development within the project. The report shall be reviewed and approved by the City Engineer prior to issuance of a grading permit. _ 13. All required fees shall be paid prior to issuance of any building permit. 14. The parking lot entry from Junipero Serra shall be designated right turn only. Its implementation shall not be permitted until a raised median is constructed in Junipero Serra such that it will prohibit left turn movements. 15. Roof materials shall be wood shingle or tile of a similar appearance. 209 16. Prior to the issuance of any building permits, the grading plan for AC 80-3 shall be reviewed and approved by the Planning Commission. Said grading plan shall indicate, by means of cross sections, the difference in finished grades proposed along the common property line with the residential neighborhood bordering the property on the east known as "The Casitas."
