TENTATIVE TRACT 10634 (PUEBLO SERRA)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING TENTATIVE TRACT MAP 10634
WHEREAS, the applicant, First Commercial Enterprise,
2801 Barranca, Irvine, California, has submitted Tentative Tract
Map 10634, proposing to subdivide approximately 29.8 + acres of
land into 10 lots, located on Assessor's Parcels Nos. 649-011-25
and 649-011-30; and,
WHEREAS, the City's Environmental Review Board has
determined that the proposed project will have a significant
effect on the environment, has required the preparation of an
environmental supplement concerning traffic and archaeology for a
previously certified Environmental Impact Report, said supplements
have been reviewed and certified as final by the City Council,
and has otherwise carried out all requirements of the California
Environmental Quality Act; and,
WHEREAS, the City Planning Commission has forwarded the
Tentative Tract 10634 to the City Council recommending approval;
and,
WHEREAS, a public hearing has been duly advertised and
held to review and receive public testimony on the application;
and,
WHEREAS, the City Council of the City of San Juan
Capistrano finds and determines as follows:
1. The proposed project as conditioned, and its
design and improvements are consistent with the PC
(Planned Community) designation on the General
Plan Map and is otherwise consistent with all
other Elements of the General Plan.
2. The proposed project, as conditioned, conforms to
all applicable requirements of Title 9 of the
City's Municipal Code (Land Use) and is consistent
with Comprehensive Development Plan CDP 75-1.
3. The project site is physically suitable for the
type and density of the proposed development.
4. The design and improvements of the proposed project
will not cause substantial environmental damage;
nor will said design or improvements avoidably
injure wildlife or their habitat.
5. The design or improvements of the proposed project
will not cause serious public health problems.
6. The design or improvements of the proposed project
will not conflict with easements acquired by the
public at large for access through or use of
property within the proposed project.
7. The design or improvements of the proposed project
will not interfere with the maintenance or
preservation of an historical site.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby approve Tentative
Tract 10634 subject to the following conditions:
1. The applicant shall design and install the necessary
water facilities to serve the project. Said
facilities shall be reviewed and approved by
Orange County Waterworks District No. 4.

2. The applicant shall be required to pay all
applicable development fees.
3. Vehicle access rights along Junipero Serra and
Camino Capistrano shall be dedicated to the City
except at street intersections and designated
access drives per Architectural Ccontrol 80-3.
4. The applicant shall dedicate an easement over the
private streets for utilities and emergency services
to the City of San Juan Capistrano.
5. All utilities shall be undergrounded within the
project.
6. Prior to approval of the Final Map, the applicant
shall enter into an agreement to maintain the
landscape area located within the public right-of-
way.
7. All necessary utility easements shall be a minimum
20' in width and dedicated to the City.
8. The applicant shall enter into an agreement to
participate in the installation of a traffic
signal at Junipero Serra and Camino Capistrano. ..
9. Street lights and traffic signals shall be installed
according to Section 9-4.108 of the Municipal Code
and accepted City policy.
10. Sanitary sewers shall be designed, constructed and
dedicated according to Section 9-4.111 of the
Municipal Code.
11. Drainage facilities shall be designed, constructed
and dedicated according to Section 9-4.110 of the
Municipal Code.
12. The applicant shall enter into an agreement to
participate in preliminary engineering for the
alignment of Junipero Serra at Alipaz Street and
Trabuco Creek. The precise alignment of and
dedication of Junipero Serra shall be completed as
a condition of approval of Phase IT. Prior to
approval of the Final Map, the alignment for
Camino Capistrano shall be established and right-
of-way dedicated.
13. The applicant shall be required to dedicate and
improve Camino Capistrano and Junipero Serra in
accordance with Ordinance No. 297 (Pueblo Serra
Planned Community) as amended by City Council
Resolution No. 80-10-15- .
14. Driveways, pedestrian ways, bikeways, equestrian
trails, utility undergrounding, street lights,
traffic signals, drainage facilities, and sanitary
sewers shall be located and constructed in
accordance with Article 9-4.1 (Design Standards
and Requirements) of the Municipal Code and adopted
City policy.
15. Final alignments for

16. A geotechnical feasibility study shall be completed
to determine the seismic safety and soils stability
of all proposed grading and development within the
project. The report shall be reviewed and approved
by the City Engineer prior to approval of a final
map.
