AMENDMENT TO RESOLUTION NO. 79-10-17-4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING
CONDITION NO. 7 OF ITS RESOLUTION CONDITIONALLY
APPROVING REVISED TENTATIVE TRACT 10103
(GOEDEN AND COMPANY)
WHEREAS, revised Tentative Tract No. 10103 was
conditionally approved by City Council Resolution No. 79-10-17-4;
and,
WHEREAS, Goeden and Company, Inc. , the current developer
of the aforesaid Tract, has requested a modification of Condition
No. 7 to permit them to postpone the installation of bikeways,
equestrian trails, recreation facilities and slope landscaping;
and,
WHEREAS, the City Council has found and determined that
the aforesaid improvements and/or facilities can, with appropriate
safeguards, be installed "during the first phase of home construction"
rather than "prior to issuance of building permits. "
NOW, THEREFORE, BE IT RESOLVED that Condition No. 7 of
the Resolution conditionally approving revised Tentative Tract
10103 is hereby amended to read as follows :
7. Slope landscaping, bikeways, equestrian trails,
and recreation facilities designated on the approved
landscaping plan shall be installed during the
first phase of home construction. To ensure
installation, a cash deposit or letter of credit
in the amount of 50 percent of the cost of the
above landscaping and other facilities, shall be
submitted to the City prior to issuance of any
residential building permit. Installation of such
slope landscaping and other facilities shall then
be commenced prior to the first building inspection
(i. e. trenching or foundation) of any residential
unit. Installation of slope landscaping and
other facilities shall then be diligently pursued
to completion. There shall be no final inspection
of any residential unit in the 1980 allocation
(Phase I) and there shall be no issuance of any
building permits for any residential units in the
1981 allocation (Phase II) until the City gives
final approval of the completed facilities and of
the healthy establishment of all required slope
landscaping. Notwithstanding the foregoing, the
model complex on Lots Nos. 35 through 38 and 41
through 43 shall be exempted from this condition.
All bikeways and equestrian tails, except Lot
Nos. A, B and C equestrian trails, shall be designed
and constructed in accordance with Section 9-4. 106
of the Municipal Code and adopted fence and sign
standards where trails are adjacent to streets and
residential lots. Lot Nos. A, B and C equestrian

trails shall be designated trails; however,
installation of trail fencing is not required
since said lots extend through ridgeline open
space and perimeter lot fencing is required.
