RESOLUTION NO. 80-7-16-5
AMENDMENT TO PERSONNEL RULES
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING
RESOLUTION NO. 72-3-27-3, THE CITY'S PERSONNEL
RULES AND REGULATIONS
' WHEREAS, it is the intent of the City Council of the
City of San Juan Capistrano to continue to provide for a fair and
equitable personnel management system for prospective and current
employees of the City; and,
WHEREAS, the orderly administration of the personnel
management affairs of the City requires that amendments be made
to Resolution No. 72-3-27-3, the City's Personnel Rules and
Regulations; and,
WHEREAS, Section 2-5.408 of Article 4 of Chapter 5 of
Title 2 of the City of San Juan Capistrano Municipal Code provides
that adoption or amendment of the City's Personnel Rules and
Regulations shall be made by Resolution of the City Council; and,
WHEREAS, a notice of a public hearing declaring the
intent of the City Council to amend the foresaid Rules and
Regulations was duly noted in accordance with Section 2-5.408 of
Article 4 of Chapter 5 of Title 2 of the City of San Juan Capistrano
Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of San Juan Capistrano does hereby make and adopt the
' following amendments to Resolution No. 72-3-27-3, the City's
Personnel Rules and Regulations:
SECTION 1. Amendment to Rule VI, Section 4(g) (1).
Rule VI, Section 4(g) (1), First Paragraph, is amended
to read as follows:
11(1) Employees appointed at the minimum step of a
salary range shall be eligible for advancement tc
the second step in the salary range upon the
successful completion of the probationary period.
Thereafter, movement to higher steps within the
range shall require minimum service of at least
one year."
SECTION 2. Amendment to Rule VI, Section 4(g) (3
Rule VI, Section 4(g) (3) is amended to delete the
following sentence:
"The salary anniversary date shall be six months after
the date of hire."
SECTION 3. Amendment to Rule VI, Section 4.
' Rule VI, Section 4 is amended to add the following as
Section 4(k):
"(k) Any employee assigned temporarily to a position
with a salary range less than the employee's
normal assigned position shall not have a
reduction in pay during the temporary assignment,
unless such temporary assignment is for disciplinary
purposes."

SECTION 4. Amendment to Rule XI, Section 1.
Rule XI, Section 1, Second Paragraph, is amended to add
the following sentence at the end of the Paragraph:
"If such a statement is not filed, the employee shall be
deemed to be unsatisfactory. A non -promotional probationer shall
be terminated at the expiration of the probationary period. A
promotional probationer shall be reinstated at the expiration of
the probationary period to a position in the class from which he
was promoted, unless he was discharged from the City's service as
provided in the Personnel Ordinance or these Rules."
SECTION 5. Amendment to Rule XVI.
Rule XVI is amended to add the following as Section 4:
"Section 4. Evaluation of Employees.
"Each Employee shall be evaluated in accordance with
the following:
"a) A probationer shall be evaluated no later
than ten (10) working days prior to the
termination of the probationer's probationary
period.
"b) A regular employee shall be evaluated no
later than ten (10) working days prior to the
employee's salary anniversary date.
"An employee may be evaluated at any time at the direction
of the appointing authority or the Personnel Officer."
