Resolution Number 80-5-7-2027 RESOLUTION NO. 80-5-7-2 CONDITIONAL USE PERMIT 79-5 (HOFFMAN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REAFFIRMING CONDITIONAL USE PERMIT 79-5 ESTABLISHING A COMMERCIAL EQUESTRIAN STABLE (HOFFMAN) WHEREAS, the applicant, Walter Hoffman, has submitted an application for a Conditional Use Permit for the establishment of a commercial stable to be located on 27.79+ acres being described as Assessor's Parcel Nos. 124-223-50 and 124-223-69; and, WHEREAS, the City Environmental Review Board has carried out all requirements of the California Environmental Quality Act, and has determined on April 10, 1979 that the project will not have a significant impact on the environment; and, WHEREAS, the use was approved by the City Council on June 6, 1979; and, WHEREAS, the applicant did not conform to the stated conditions of approval; and, WHEREAS, a public hearing was held by the Planning Commission on October 9, 1979; and, WHEREAS, the Planning Commission determined the use was not in conformance with the conditions of approval and voted to revoke CUP 79-5; and, WHEREAS, the City Council held a public hearing on May 7, 1980, on the matter of revocation. NOW, THEREFORE, BE IT RESOLVED, that, based upon the aforesaid testimony and evidence, the City Council determines as follows: 1. All applicable conditions of City Council Resolution No. 79-6-6-2, with the exception of Condition Nos. 2 and 8, and all applicable conditions outlined in City Council actions of July 18, 1979, and October 3, 1979, have been met. 2. The proposed Conditional Use Permit is generally consistent with the goals, policies, and objectives of the General Plan. 3. The proposed use will be developed in conformance with the provisions of Ordinance No. 293, the Land Use Code. 4. That the proposed project will be compatible with existing and proposed uses within the immediate vicinity. 5. All dedication, improvements, and fee requirements will be met in accordance with City Ordinance. an t:: BE IT FURTHER RESOLVED, that the City Council does hereby reaffirm the approval of Conditional Use Permit 79-5, subject to the following conditions: 1. That all conditions of City Council Resolution No. 79-6-6-2 and all conditions outlined in the subsequent City Council actions of July 18, 1979, and October 3, 1979, remain in effect. 2. That condition Nos. 2 and 8 of City Council Resolution No. 79-6-6-2 be fulfilled and confirmed by the Director of Community Planning and Development prior to the release of the $4,000 surety and the issuance of a final certificate of use and occupancy.
