Resolution Number 81-11-17-2RESOLUTION NO. 81-11-17-2 333 INTENT TO RELEASE PROPERTY FROM WILLIAMSON ACT CONTRACT OBLIGATIONS UPON ANNEXATION TO CITY (LACOUAGUE) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING ITS INTENT TO RELEASE THE LACOUAGUE PROPERTY FROM ITS WILLIAMSON ACT CONTRACT OBLIGATIONS UPON ITS ANNEXATION TO THE CITY WHEREAS, the 260 -acre Lacouague ranch, which lies in the unincorporated County territory abutting the east City limits along its north, west, and south property lines, is now being seriously considered for development by its owner; and, WHEREAS, the City General Plan designates the subject property for residential development at approximately one unit per acre, with "open space" designations in the San Juan Creek floodplain and certain other areas of the property subject to geologic instability; and, WHEREAS, development of this property within City jurisdiction would result in a project consistent with the City General Plan, adequate mitigation of environmental impacts upon the City, and a possible estate development that preserves a substantial portion of the existing citrus trees on the property; and, WHEREAS, the property owner has filed an application with the Local Agency Formation Commission to annex the property into the City, but has indicated that completion of the annexation process is contingent upon assurance that the City will release the property from the Williamson Act contract; and, WHEREAS, the subject property is not designated in the City General Plan for permanent agricultural preservation, nor is it included in the agricultural preservation program of the City. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby declare its intention to release the property from its Williamson Act contract obligations upon annexation, subject to public hearing input, and any other requirements of Assembly Bill 2074. -1- 3 3 4 BE IT FURTHER RESOLVED, that the City Council does hereby declare its intent to take action prior to completion of the annexation process on an application to release the property from the Williamson Act contract, subject to the provisions of Assembly Bill 2074, and does hereby invite the landowner to submit such an application for immediate processing.
