Resolution Number 81-11-3-4RESOLUTION NO. 81-11-3-4 JUNIPERO SERRA ROAD EXTENSION - ALTERNATE 7 31'7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING ALTERNATE 7 BETWEEN INTERSTATE 5 AND THE WEST SIDE OF THE AT&SF RAILROAD RIGHT-OF-WAY AS THE BASIS FOR THE EXTENSION OF JUNIPERO SERRA ROAD, AND RESCINDING RESOLUTION NO. 81-9-15-1 WHEREAS, the City Council adopted Resolution No. 81-9-15-1 selecting Alternate 7 as the extension of Junipero Serra Road; and, WHEREAS, in connection with the adoption of the aforesaid resolution the following findings and determinations were made: "1. That adoption of a precise alignment for Junipero Serra Road from Interstate 5 to the extension of Alipaz Street should be deferred until completion of the circulation studies to determine the alignment of the Colinas Connector Road. "2. That the proposed developments abutting Junipero Serra Road east of the west side of the AT&SF railroad right-of-way shall be designed and constructed so as to provide the City with the option to utilize Alternate 7 in the event Junipero Serra is to be extended to intersect with Alipaz. 113. That the determination of an alignment connecting Junipero Serra Road west of the AT&SF railroad right-of-way with the extension of Alipaz Street shall occur at such time as studies of circulation in the area west of Trabuco Creek have been completed; and, WHEREAS, the true intent of the City Council was to approve the aforesaid alignment from Interstate 5 to the "west side of the Atchison, Topeka & Santa Fe railroad tracks." NOW, THEREFORE, BE IT RESOLVED, that Resolution No. 81-9-15-1 be and is hereby rescinded and the following adopted in its place and stead: WHEREAS, on April 7, 1981, the City Council initiated hearings to determine the precise alignment of Junipero Serra Road between Interstate 5 and the extension of Alipaz Street, directing that the study focus on two alignments, Alternate 7 and Alternate 9; and, -1- 3 8 WHEREAS, the City's Environmental Review Board has determined that the proposed project will have a significant impact on the environment, has required the preparation of an environmental impact report, which report has been certified as final by the City Council, and has otherwise carried out all the requirements of the California Environmental Quality Act; and, WHEREAS, on June 10, 1981, and July 22, 1981, the _ City's Traffic and Transportation Commission reviewed the two alternate alignments and forwarded a recommendation to the City Council to adopt Alternate 9; and, WHEREAS, on July 28, 1981, and August 25, 1981, the City's Planning Commission conducted duly noticed public hearings to consider the two alternate alignments and forwarded a recommendation to the City Council as follows: 1. That Alternate 9 be adopted as the precise alignment for Junipero Serra Road. 2. That a decision on the precise alignment be deferred until completion of pending circulation studies for the Colinas Connector Road. WHEREAS, the City Council of the City of San Juan Capistrano, on September 15, 1981, held a duly advertised public hearing to determine the precise alignment of Junipero Serra Road; and, WHEREAS, the City Council of the City of San Juan Capistrano finds and determines as follows: 1. That adoption of a precise alignment for Junipero Serra Road from the west side of the Atchison, Topeka & Santa Fe railroad tracks should be deferred until completion of the circulation studies to determine the alignment of the Colinas Connector Road. 2. That proposed developments abutting Junipero Serra Road east of the west side of the Atchison, Topeka & Santa Fe railway right-of-way shall be designed and constructed so as to provide the City with the option to utilize Alternate 7 in the event Junipero Serra Road is to be extended to intersect with Alipaz Street. - 3. That the determination of an alignment connecting Junipero Serra Road west of the Atchison, Topeka & Santa Fe railway right-of-way with the extension of Alipaz Street shall occur at such time as studies of circulation in the area west of Trabuco Creek have been completed. -2- 319 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby establish Alternate 7 as the basis for planning right-of-way and property development east of the Atchison, Topeka & Santa Fe railway right-of-way abutting Junipero Serra Road, requiring development proposals in this area to follow the alignment shown in Exhibit "A," attached.
