Resolution Number 81-8-4-6RESOLUTION NO. 81-8-4-6 STATE CONSTITUTIONAL AMENDMENT RELATING TO TAXATION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REQUESTING THE LEGISLATURE OF THE STATE OF CALIFORNIA TO PROPOSE TO THE PEOPLE OF THE STATE OF CALIFORNIA AN AMENDMENT TO THE CONSTITUTION OF THE STATE BY AMENDING SECTION 1 OF ARTICLE XIII A, RELATING TO TAXATION 211 WHEREAS, it is in the public interest and welfare to maintain a healthy, safe and wholesome environment; and, WHEREAS, local agencies need capital facilities and improvements such as libraries, parks, storm drains, etc.; and, WHEREAS, although local electors by a two-thirds vote may approve the issuance of general obligation bonds to provide needed capital facilities and improvements, current provisions of Article XIII A of the California Constitution prohibit local agencies from issuing such general obligation bonds; and, WHEREAS, Article XIII A presently restricts the financing of critically needed capital facilities and improvements for local agencies with no other means of financing. NOW, THEREFORE, BE IT RESOLVED, that the Legislature of the State of California is requested to propose to the people of the State of California a clearly written amendment to the Constitution of the State by amending Section 1 of Article XIII A, relating to Taxation, to provide authorization to local agencies to issue bonds constituting a general obligation of the agency if approved by the affirmative vote of two-thirds of the electors voting on such measures, and return of local control to local jurisdictions.
