ARCHITECTURAL CONTROL 81-5 (ITOP SCHOOL)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, CONDITIONALLY
APPROVING ARCHITECTURAL CONTROL 81-5 (ITOP
SCHOOL)
WHEREAS:
1. The applicant, ITOP Center for Learning, 23133
Orange Avenue, E1 Toro, California, 92630, has
submitted an application for approval of temporary
buildings for a school site.
2. The City's Environmental Review Board has determined
that the proposed project will not have a significant
effect on the environment, has accordingly issued
a negative declaration for the project, and has
otherwise carried out all requirements of the
California Environmental Quality Act; and,
3. The City Council hereby finds and determines as
follows:
a. The project is consistent with all applicable
goals, objectives, and policies of the General
Plan.
b. The project, as designed and conditioned, is
consistent with all applicable requirements
of Title 9 (Land Use) of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby approve Architectural Control 81-5 (ITOP School),
subject to the following conditions:
1. Expiration of Approval - Per Section 9-2.305 of
the Municipal Code, this project development
approval shall expire on May 5, 1982--i.e., one
year from the City Council approval date. If no
building permit has been issued for the project by
that date, the development approval shall become
null and void.
2. Building Plans - Final building plans (working
drawings) shall be reviewed by the Architectural
Board of Review and shall be approved only if said
Board determines that the working drawings are
consistent with the concept plans approved with
this Resolution.

Landscape Plans - Final landscape and irrigation
plans shall be reviewed by the Director of
Community Planning and Development and shall be
approved only if the Director determines that said
plans are consistent with the concept plans
approved with this Resolution.
4. Lighting - The lighting units shall be no greater
than 8 feet high.
5. Roof Materials - The roof shall be painted a dark
earthtone color.
6. Details - Wood decking and stairs shall be provided
around the building.
7. Time Limit - The temporary structures shall be
permitted for a period not to exceed two (2) years
from the initial date of occupancy. The Planning
Commission may approve a one-year extension to
said period, provided that the permanent
construction of the structure has been initiated on
site for the school prior to the end of the initial
two-year period. Upon issuance of use and occupancy
permits for the school, the temporary structures
shall be removed within 90 days.
8. Water - Water transmission and distribution
facilities shall be designed, constructed, and
dedicated in accordance with Section 9-4.109 of
the Municipal Code and the requirements of Orange
County Water Works District #4. Such distribution
facilities and appurtenances shall be approved by
the County Fire Marshal.
9. Slopes - All manufactured slopes shall be designed
and constructed in accordance with Section 9-3.505
and 9-4.112 of the Municipal Code. All such
slopes shall be 2:1 ratio or flatter.
10. Other Improvements - Driveways, pedestrian ways,
bikeways, equestrian trails, utility undergrounding,
street lights, traffic signals, drainage facilities,
and sanitary sewers shall be located and constructed
in accordance with Article 9-4.1 (Design Standards
and Requirements) of the Municipal Code and adopted
City policy.
11. Geotechnical Study - A geotechnical feasibility
study shall be completed to determine the seismic
safety and soils stability of all proposed grading
and development within the project. The report
shall be reviewed and approved by the City Engineer
prior to issuance of a grading permit.

12. Fees - All required fees shall be paid prior to
issuance of any building permit.
