OPPOSING MANDATING OF SOCIAL IMPACT SUITS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, OPPOSING
THE MANDATING OF SOCIAL IMPACT SUITS AND
DECLARING THAT IF SAID MANDATING IS NOT
TERMINATED THE CITY WILL RECOMMEND TO THE
ORANGE COUNTY BOARD OF SUPERVISORS THAT FUNDS
TO THE LEGAL AID SOCIETY BE DISCONTINUED
WHEREAS, the Board of Supervisors of the County of
Orange ("Board") has appropriated public funds to private civic
and service organizations to help meet certain community needs;
and,
WHEREAS, the Orange County Legal Aid Society ("Legal
Aid") has received and continues to receive such funds for
certain purposes designated by the Board; and,
WHEREAS, the City Council has been informed that some
of the funds received by Legal Aid from the Board are being
expended for the filing and pursuit of social impact lawsuits;
and,
WHEREAS, the City Council has been informed that Legal
Aid believes that Legal Aid is mandated to bring such social
impact suits; and,
WHEREAS, the City Council believes that the elected
legislative representatives of each community are capable of
responding to the needs of their communities and are subject to
the will of the people through the elective processes if they do
not respond; and,
WHEREAS, such lawsuits may pose a threat to public
agencies in that they could be used to attempt to exert pressure
on local public officials to accede to political and social
demands of the filers; and,
WHEREAS, when used in the ways described hereinabove,
the City Council of the City of San Juan Capistrano opposes such
lawsuits being funded by the County of Orange.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of San Juan Capistrano that it is opposed to the
mandating of lawsuits being filed and pursued by Legal Aid which
are designed as vehicles for political or social impact.

BE IT FURTHER RESOLVED that, if said mandating of such
lawsuits is not terminated, the City hereby recommends to the
Orange County Board of Supervisors that County funding to the
Orange County Legal Aid Society be terminated.
AND BE IT FURTHER RESOLVED that the City Clerk is
directed to submit this Resolution to the Orange County Board of
Supervisors.
